These Rules establish classes of public contracts which are exempt from the formal competitive <br />solicitation requirements of the Public Contracting Code. These exemptions may be used by the Contracting <br />Agency without additional findings of fact except as otherwise set forth herein. These exemptions are in addition <br />to all contracting exemptions as set forth in the Code and the Contracting Agency’s Public Contracting Rules, <br />Divisions 46, 47, 48, and 49. Additional contracts or classes of contracts may be expressly exempted from <br />competitive solicitation requirements by ordinance or resolution of Contracting Agency pursuant to the <br />Contracting Agency Rules and ORS 279A.025, ORS 279B.085, and 279C.335. <br />The following procurements are exempt from competitive solicitation requirements regardless of dollar value <br />unless specifically indicated. <br /> <br /> <br />E1. Social Services Providers <br />Social Services Provider is defined as public or private providers of services intended to aid <br />disadvantaged, distressed, or vulnerable persons or groups. <br />1) Social Service Provider contracts involving an anticipated amount of less than $150,000, Contracting <br />Agency may negotiate a contract for such services in any manner deemed practical by the Solicitation <br />Agent. <br />2) Social Service Provider contracts involving an anticipated amount of more than $150,000, Contracting <br />Agency shall award in accordance with the policies and procedures approved by the Purchasing <br />Agent. <br /> <br /> <br />E2. Advertising <br />Purchase of advertising, including that intended for the purpose of giving public or legal notice, from print <br />media vendors, radio and television vendors, and internet social media vendors. <br /> <br /> <br />E3. Equipment Maintenance and Repair <br />Purchase of equipment, repair, overhaul, and maintenance goods and services if the purchase meets <br />one of the following conditions: <br />1) The service or parts required are unknown and the cost cannot be determined without extensive <br />preliminary investigation, e.g. dismantling or testing; <br />2) Delay of repairs would jeopardize the Contracting Agency’s ability to provide services; or <br />3) The service or parts required are: (a) for sophisticated equipment for which specially trained <br />personnel or specific parts are required; (b) such personnel or parts are available from only one <br />source; and (c) conducting a competitive process is impractical. <br /> <br /> <br />E4. Contracts for Government Regulated Items <br />Purchase of goods or services where the rate or price for the goods or services being purchased is <br />established by federal, state, or local regulatory authority. (i.e. postage, certain utilities, refuse hauling).
