<br />University Park reconfiguration, see the attached City Council Agenda Item <br />Summary and Council minutes, dated September 28, 2005. <br /> <br />10. How will the process for adoption of the PROS Projects and Priorities Plan <br />move forward and could a resolution without a public hearing be used to <br />approve projects in the future? <br /> <br />Staff Response: The PROS Projects and Priorities Plan identifies projects and <br />suggested priorities, and is based on input from thousands of Eugene residents. <br />By nature, the PROS Projects and Priorities Plan needs to be flexible; priorities <br />need to be able to shift in order to respond to funding opportunities, community <br />trends and needs. <br /> <br />An earlier draft of the PROS Comprehensive Plan included a detailed project list. <br />That project list was (and is) intended to comply with state statutory system <br />development charge (SDC) requirements set forth at ORS 223.304 and ORS <br />223.209. In order to preserve the necessary flexibility of the project list, the list <br />was separated from the PROS Comprehensive Plan and will be presented to the <br />City Council for adoption as part of the PROS Priorities and Projects Plan. <br /> <br />The PROS Priorities and Projects Plan is proposed for adoption by Council <br />Resolution. Although a public hearing is not legally required for this process, <br />one will be held. Adoption of the proposed PROS Priorities and Projects Plan <br />will follow the Comprehensive Plan adoption and is currently scheduled for <br />January, 2006. Once the separate adoption processes are complete, the PROS <br />Priorities and Projects Plan will be attached to the PROS Comprehensive Plan <br />document as an appendix. The PROS Comprehensive Plan will explicitly state <br />that the PROS Priorities and Projects Plan is being appended for reference <br />purposes only and is not being adopted as a part of the PROS Comprehensive <br />Plan. Prior to the final adoption of the PROS Priorities and Projects Plan by <br />Council resolution, City staff will include an appendix place-holder for the <br />document to be inserted into the PROS Comprehensive Plan after adoption. <br /> <br />Amendments to the PROS Priorities and Projects Plan will be made by Council <br />Resolution. Whether or not a public hearing is held on a proposed amendment <br />will be a Council decision. The project list will be required to be updated each <br />time the SDC methodology is updated. This process includes public hearings <br />and occurs approximately every five years. Another opportunity for amending <br />the project list may occur with the annual budget process. This process also <br />includes public hearings. <br /> <br />The types of action necessary to implement specific projects listed in the PROS <br />Priorities and Projects List will vary depending on the type of land to be used for <br /> <br />Attachment A <br /> <br />October 31, 2005 <br /> <br />Page 8 <br />
