That property is contained in and is a part of the Junction City Water Control District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. KK. The Lane County Local Government Boundary Commission by its Final Order No. 1150 dated April 8, 1999, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective May 24, 1999. Tax Lot 100, Assessor's Map 17-04-14-34, located in the River Road region of north Eugene, on the site of Kelly Middle School and Howard Elementary School, south of Howard Avenue, East of North Park Avenue and North of Hatton Avenue, and more particularly described on Exhibit KK attached hereto and incorporated herein by reference. (School District 4J, C EU 99-23) That property is contained in and i~ a part of the Santa Clara Water District, River Road Water District, and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. LL. The City has authority under ORS 199.510 and 222.520 to 222.575 tCI withdraw the ten"ttories from the Districts without referring the withdrawals to the Boundary Commission. NO\V, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. The City Council proposes that the territory bounded by the line running as follows, which has heretofore been annexed to the City of Eugene, shall be withdrawn from the River Road Water District and River Road Parks & Recreation District: Tax Lot 600, Assessor's Map 17-04-23-12, located in the River Road region of north Eugene, west of River Road, north of Horn Lane, east of Sunny Drive, and more particularly described on Exhibit A attached hereto and incorporated herein by reference.
