ORDINANCE NO. ~;Z j~ <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF <br />PROCEEDINGS IN EMINENT DOMAIN FOR THE <br />ACQUISITION OF PROPERTY INTERESTS FOR THE <br />FERRY STREET BRIDGE CORRIDOR PRESERVATION - <br />ENHANCEMENT PROJECT (JOB #905; AND DECLARING <br />AN EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />A. The City Council has authority under provisions of the City Charter and applicable <br />state law to institute proceedings in eminent domain for the acquisition by condemnation of private <br />property for public purposes, including the construction of a bikelpedestrian bridge, paths and <br />undercrossings; improvements to streets and vehicular structures; installation of traffic signals, <br />sidewalks, landscaping and other public improvement features; and the realignment of traffic <br />flow. <br />B. The Council approved the design concept far the Ferry Street Bridge Preservation- <br />Enhancement Project on August 9, 1995 and reaffirmed the project on September 30, 1996. A <br />federal grant will pay for So per cent of the project costs, and City of Eugene and Lane County <br />finds have been budgeted to provide local matching funds. <br />C. The proposed improvements are incompliance with and in furtherance of the plans <br />and specifications prepared by the City Engineer in accordance with provisions of Chapter 7 of <br />the Eugene Code, 1971 and applicable policies of the City of Eugene. <br />D. The project is necessary in order to preserve and improve existing structures and <br />roadways in the Ferry Sheet Corridor, to enhance safety and access for all modes of travel in the <br />corridor, and to construct and improve facilities for bicycles, pedestrians, transit, and motor <br />vehicles using this major transportation facility. The planned improvements address these public <br />needs in a manner that is the most compatible with the greatest public good and least private <br />.. <br />~n~ury. <br />E. The requirements of federal and state officials relating to obligation of federal grant <br />funds for these corridor improvements, and the need to facilitate the safe and efficient movement <br />of traffic, transit, bicyclists, and pedestrians requires the Ci to act rom tl to ac wire the <br />tY p P y q <br />necessary property interests for this project.
