No signs, striping, graphics or ather attention getting <br />devices are permitted on the transmission tower or ancillary facilities except <br />for warning and safety signage with a surface area of no more than three <br />square feet. Such signage shall be affixed to a fence or ancillary facility and <br />the number of signs is limited to no more than two. <br />9 Standards for A ,,, .,, <br />~ } _ ,,, ,ncillary Facilities. All ancillary facilities shall comply with the <br />standards of subsections ~8}fie} and ~8}~f} of this section. In addition, all ancillary facilities <br />within an RA, R-1, PL, C-1 and ~~ zoning district must be located underground tv the <br />maximum extent technology allows, unless a variance is obtained pursuant to the <br />provisions of subsection X10} of this section. This restriction does not apply within other <br />zoning districts. <br />X10} Variance. <br />~a} Any variance to the requirements of section 9.900 shall be <br />granted only pursuantto the following provisions. The criteria for granting a <br />variance shall be limited to section 9.900, and shall not include the criteria <br />in 9.740. <br />fib} The city maygrant a variancefrom the provisions ofsubsection <br />~8}~a} of this section providing the applicant demonstrates that: <br />1, It is technologically impossible to locate the proposed <br />tower on available sites more than 2,000 feet from apre-existing <br />transmission tower and still provide the approximate coverage the <br />tower is intended to provide; <br />2. The pre-existing transmission tower that is within 2,000 <br />feet of the proposed tower cannot be modified to accommodate <br />another provider; and <br />3. There are no available buildings, light or utility poles, or <br />water towers on which antennas maybe located and still provide the <br />approximate coverage the tower is intended to provide. <br />~c} The city may grant a variance to the setback and <br />undergrounding requirements of subsections ~8}~d} or ~9} upon finding that <br />stealth design, proposed landscaping, configuration of the site, or the <br />presence of mature trees obviates the need for compliance. <br />~d} The city may grant a variance to the 75 foot height limitation in <br />the R-1 and RA zoning districts to a maximum of 100 feet providing the <br />applicant demonstrates that a transmission tower taller than 75 feet will <br />directly eliminate the need for one or more additional transmission towers in <br />an RA or R-1 zoning district. <br />fie} if the proposed transmission tower or ancillary facility requires <br />site review or a conditional use permit, the request for variance shall be <br />considered as part of the site review or conditional use permit process, lfthe <br />proposed transmission tower or ancillary facility is an outright permitted use, <br />the request far a variance shat! be processed pursuant to section 9.732 et. <br />Ordinance - IO <br />
