ORDINANCE NO. 20083 <br />AN ORDINANCE CONCERNING TELECOMMUNICATIONS; <br />ADDING SECTIONS 3.400, 3.405, 3.410, 3.415, 3.420, 3.425, <br />AND 3.430 TO THE EUGENE CODE, 1971; AMENDING <br />SECTIONS 3.005, 7.290, 7.295, 7.297, 7.299, 7.300, AND <br />7.302 OF THAT CODE; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 3.005 of the Eugene Code, 1971 is amended by adding the <br />following caption and definitions in alphabetical order in the Licensed Businesses section <br />therein: <br />Telecommunications: <br />Cable service: ' <br />(a) The one-way transmission to subscribers of (i) video <br />programming, or (ii) other programming service, and <br />(b) Subscriber interaction, if any, which is required for the selection <br />or use of such video programming or other programming service. <br />Cable System. A facility, consisting of a set of closed transmission <br />paths and associated signal generation, reception, and control equipment <br />that is designed to provide cable service which includes video programming <br />and which is provided to multiple subscribers within a community. A <br />reference to a cable system includes pedestals, equipment enclosures (such <br />as equipment cabinets), amplifiers, power guards, nodes, cables, fiber optics <br />and other equipment necessary to operate the cable system. As used <br />herein, cable system does not include: <br />(a) A facility that serves only to retransmit the television <br />signals of one or more television broadcast stations; <br />(b) A facility that serves subscribers without using any <br />public right-of-way or public utility easements; <br />(c) A facility of a common carrier which is subject, in whole <br />or in part, to the provisions of Title II (Common Carriers) of the <br />Communications Act of 1934, as amended, except that such facility <br />shall be considered a cable system to the extent such facility is used <br />in the transmission of video programming directly to subscribers; <br />(d) Any facilities of any electric utility used solely for <br />operating its electric utility systems; or <br />Ordinance - 1 <br />
