<br />9.2761 <br /> <br />Special Standards for Table 9.2760. <br /> <br />(5) Exceptions to the maximum lot size shall be granted if any of the following is <br />met: <br />(a) Existing physical circumstances such as topographically constrained <br />lands, conservation easements, existing buildings, or utility easements <br />prevent the ability to further divide the lot. <br />(b) The lot exceeding the maximum lot size is intended to reserve a large lot <br />for future land division with feasibility demonstrated by a conceptual <br />buildout plan. <br />(c) The subdivision achieves a minimum density of 9 units per net acre. <br />(d) The exception will enable protection of natural resources. <br /> <br />Section 15. Subsection (1) and (2)(a) of Section 9.2775 of the Eugene Code, 1971, are <br /> <br />amended to provide: <br /> <br />9.2775 <br /> <br />to provide: <br /> <br />9.2795 <br /> <br />Residential Flaa Lot Standards for R-1. <br />(1) Purpose. Residential flag lots allow lots to be created in cases where there is <br />adequate lot area to divide the property into 2 or more lots but not enough <br />street frontage to meet the standard minimum requirement and where creation <br />of a street is not necessary to meet connectivity standards. The standards <br />require access for fire protection. The intent is to provide additional housing <br />opportunities and to promote the efficient use of residential land. Home <br />occupations and secondary dwellings are prohibited because of limited access <br />and the greater impacts these uses would place on abutting sites. <br />(2) Measurements. <br />(a) Flaa Lot Dimensions. Residential flag lot width dimension is measured <br />from the mid-point between two opposite lot lines of the flag portion of the <br />lot. <br /> <br />Section 16. Subsection (3)(a) of Section 9.2795 of the Eugene Code, 1971, is amended <br /> <br />Solar Setback Standards. <br /> <br />(3) Exemptions to Solar Setback Requirements. A building is exempt from the <br />solar setback standards when any of the following conditions exist: <br />(a) Slopes. The lot on which the building is located has an average slope of <br />20 percent or more in a direction greater than 45 degrees east or west <br />of true north. <br /> <br />Section 17.
