ORDINANCE NO. ~~ ~ <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF PROCEEDINGS <br />IN EMINENT DOMAIN FOR THE ACQUISITION" BY CONDEMNATION <br />OF PROPERTY INTERESTS ALONG BARGER DRIVE FROM TERRY <br />STREET TO GREENHILL ROAD; ALONG THE wEST SIDE OF THE <br />BETHEL SCHOOL DISTRICT #5Z PRgPERTY; AND NORTH FROM <br />BARGER DRIVE ALgNG THE URBAN GROWTH BOUNDARY TO AND <br />ALgNG THE SOUTH SIDE OF THE A2 CHANNEL, FOR THE PURPOSES <br />OF CONSTRUCTION OF STREET IMPROVEMENTS, A PUBLIC ACCESS <br />wAY, AND wASTEwATER AND STORM DRAINAGE SYSTEMS. <br />The City Council of the City of Eugene lends that: <br />A. ~ The City Council has authority under provisions of the City Charter and applicable <br />state law to Institute proceedings in eminent domain for the acquisition by condemnation of private <br />property for public purposes, including the improvement of city streets, construction of curbs, <br />gutters, street lights, pedestrian signals, public access ways, street trees, wastewater and storm <br />drainage systems, and extensions of storm drainage systems. <br />B. The Council adapted the FY'9S Capital Improvement Plan and Capital Budget and <br />by motion on July 2S, 1997 approved initiation of the design, acquisition and bidding of the <br />proposed improvements on Barger Drive from Terry Street to Greenhill Road, and construction <br />of the new nortlalsouth street along the west side of the Bethel School District #52 property. The <br />adopted FY' 9S C1P and Capital Budget also includes the Barger-Greenhill Pump Station and <br />associated wastewater system. <br />C. The proposed improvements shall be in compliance with, and in furtherance of, the <br />plans and specifications to be prepared by the City Engineer in accordance with provisions of <br />Chapter 7 of the Eugene Cade, 1971, and applicable polices of the City of Eugene. <br />D, Development, increased traflxc, and the construction of a new Bethel School <br />District #52 elementary school necessitate the construction of the street improvements and <br />wastewater and storm drainage systems to serve the surrounding neighborhood and School District <br />#52. <br />E. The costs of delaying the project, the need to provide the infrastructure extensions <br />to serve the planned developments, the savings to be realized from efficient construction <br />management techniques, and the need to facilitate the safe and efficient movement of vehicular <br />and pedestrian traffic requires that the City act promptly to acquire the necessary property <br />interests for this project. Such acquisition minimizes disruption and injury to private property <br />interests while affording a significant public good, <br />Now, therefore, <br />Ordinance -1 <br />
