ORDINANCE NG. X0112 <br />AN ORDINANCE IMPLEMENTING AMENDMENT IV TG THE EUGENE <br />CHARTER OF 1976. <br />The City Council of the City of Eugene finds that: <br />A. Amendment IV to the Eugene Charter of 1976 was adopted at the general election <br />on November 5,1996. The Amendment provides in part that hazardous substance users in Eugene <br />shall ~.le an annual materials balance repart that lists inputs and outputs of all hazardous substances <br />obtained, used or generated. The Amendment directs the City Council to appoint a Toxics Board <br />consisting of seven persons to enforce and implement the Amendment. The Council has appointed <br />such a Board, which has developed Hazardous Substance Reporting Forms and Instructions ~"the <br />Instructions"} to assist persons who are required to file a report under the Amendment. <br />B. Article X of Amendment IV provides in part that the Amendment's provisions are <br />self executing insofar as it is reasonable and practicable to so assume, In every other case, Article <br />X of Amendment IV authorizes the Council to enact reasonable ordinances that are necessary and <br />proper to implement the Amendment. <br />C. The Instructions developed by the Toxics Board include numerous provisions that <br />simply describe explicit provisions of Amendment IV. The instructions also contain some <br />interpretations of the Amendment and some provisions which are necessary to implement the <br />Amendment in a practicable manner but which are not expressly contained in the Amendment. The <br />Toxics Board has recommended that the Council adopt the Instructions. <br />D. The Council approves of the Instructions as consistent with the terms and intent of <br />Amendment IV. The Council intends by this ordinance to adopt the Instructions as binding on those <br />persons covered by its terms. <br />E. The Council adopts this ordinance pursuant to its authority under both section 4 of <br />the Eugene Charter of 1976 and Article X of Amendment IV. <br />
