2.43 o Labor Contract Conditions. All contracts executed by the city wherein labor is <br />required, except contracts for the purchase of materials and supplies, shall contain the <br />following provisions: <br />~a} A statement that the contract will comply with all provisions required <br />by the statutes of the state, of contractors on a "public contract," as defined in ORS <br />279.3141}. <br />fib} A statement that the contractor will comply with all of the <br />requirements of sections 4.615 to 4.655. <br />~c} A statement that the contractor shall, in the event helshe willfully <br />violates the provisions of this section, or knowingly files false affidavits of <br />compliance, waive for a period of One year any right to bid upon any public works <br />prof ect let by the city. <br />(d} if a contractor or subcontractor violates the provisions of this section, <br />the city manager may at his~her option, terminate said contract or subcontract and <br />said contractor or subcontractor in such event shall forfeit all rights under hislher <br />contract except to payment for actual labor and materials furnished to the city. The <br />city manager may waive in whale ar in part any forfeitures or sanctions provided in <br />subsection ~c} above. <br />Section 7. Section 2.500 of the Eugene Code, 1971, is amended to provide: <br />2.540 Finance Dfficer and Ci Recorder - Def ned. As used in this code "finance <br />officer" and "city recorder" shall mean the persons} appointed by the city manager <br />to perform the functions and duties of .city recorder and city treasurer. <br />Section S. The City Recorder, at the request of, or with the concurrence of the City Attorney, <br />is authorized to administratively correct any reference errors contained herein or in other provisions <br />of the Eugene Code,1971, to the provisions added, amended or repealed herein. <br />Section 9. The City Recorder shall amend the sections of the Eugene Code, 1971, as <br />noted above, and with the concurrence of the City Attorney, is further authorized to make changes <br />to provisions of the Eugene Code, 1971 to make the Code language gender neutral. <br />Passed by the City Council this <br />6th day of April,1998. <br />City Recorder <br />Approved by the Mayor this <br />6th day of Apri1,1998. <br />Dr finance - 2 <br />
