ORDINANCE N0.20122 <br />AN ORDINANCE CONCERNING THE DOwNTOwN MALL; <br />AMENDING SECTION 4.680 OF THE EUGENE CODE, 1971; <br />AND PROVIDING AN AUTOMATIC REPEAL AS OF MARCH <br />31,1999. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 4.680 of the Eugene Code,1971, is amended to provide: <br />4.680 Acts Prohibited at Ni ht. <br />~1} Between the hours of 10:00 p.m. of one day and 6:04 a.m. of the succeeding <br />day, no person shall: <br />~a} Be in a cemetery without authorization. <br />fib} Drive or park a motor vehicle in a cemetery without authorization. <br />~2} Between the hours of 11;00 p.m, of one day and 6:00 a.m. of the succeeding <br />day, no person shall be in a city park unless driving through the park on lawful business. <br />~3} Between the hours of 1:04 a.m. of one day and 6:00 a.m., no person shall be <br />in the Broadway portion of the mall, which is defined as the area of Broadway from the east mar in <br />g <br />of Charnelton Street to the west margin of ~U~llamette Street; the alley between Broadway and Tenth <br />Avenue from the west margin of Willamette Street to 160 feet west of the west margin of Willamette <br />Street. The prohibition of this subsection does not apply to persons who reside within that area, to <br />employees andlor owners of businesses within that area, or to persons who walk through that area <br />without stopping. <br />~4} Upon finding it to be in the public interest and consistent with council goals <br />and policies, the council may, by motion, exempt a special event from the prohibitions of subsectior~~` <br />. ~ <br />~2} and ~3} of this section, The motion shall specify the period of time and location covered by the <br />exemption. <br />Section 2. The City Recorder, at the request of, or with the concurrence of the City Attorney, <br />is authorized to a ' 'stratively correct any reference errors contained herein or in other provisions <br />of the Eugene Code,1971, to the provisions added, amended or repealed herein. <br />Ordinance 1 <br />
