ORDINANCE No. <br />AN ORDINANCE ADOPTING THE 1999 HAZARDOUS SUBSTANCE <br />TRACKING INSTRUCTIONS. <br />The City Council of the City of Eugene finds that: <br />A. Amendment N to the Eugene Charter of 1976 was adopted at the general election <br />on November 5,1996. The Amendment provides in part that hazardous substance users in Eugene <br />shall hie an annual materials balance report that lists inputs and outputs of all hazardous substances <br />obtained, used or generated. By Ordinance No. 20112 adopted by the Council and approved by the <br />Ma or an A ril 6,1998, the City Council adopted the 1998 Hazardous Substance Reporting Forms <br />y p <br />and Instructions the "instructions"} attached as Exhibit A to the Ordinance. <br />B. The Toxics Board has reviewed the 1998 Instructions, and developed the 1999 <br />Hazardous Substance Tracking Instructions for reports due April 1, 2000. In the 1999 Instructions, <br />the format has been changed to provide greater clarity and ease of use, and some changes and <br />updates to the prior Instructions have been made, such as providing a definition of the term "article," <br />and adding a question and answer section that lists questions which have been posed by businesses <br />and the responses from the Toxic Board. <br />C. The 1999 Instructions developed by the Toxics Board also include numerous <br />provisions that simply describe explicit provisions of Amendment N; some interpretations ofthe <br />Amendment; and some provisions which are necessary to implement the .Amendment in a practicable <br />manner but which are not expressly contained in the Amendment. The Toxics Board has <br />recommended that the Council adopt the 1999 Instructions. <br />D. The Council approves the 1999 Instructions as being consistent with the terms and <br />intent of Amendment IV. The Council intends by this ordinance to adopt the 1999 Instructions as <br />binding on those persons covered by its terms. <br />E. The Council adopts this ordinance pursuant to its authority under both section 4 of <br />the Eugene Charter of 1976 and Article ~ of .Amendment N. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLO'~VS: <br />The 1999 HAZARDOUS SUBSTANCE TRACKING INSTRUCTIONS, for reports due <br />April 1, 2000, prepared by the Toxics Board and a copy of which is attached hereto as Exhibit A, <br />are hereby adopted by the Council. <br />Passed by the City Council this <br />day of,~~,~~, 1998. <br />c.. <br />City Recor er <br />98. <br />Approved by the Mayor this <br />
