ORDINANCE NO. a 3 <br />AN ORDINANCE VACATING THE CUL-DE-SAC LOCATED <br />UN THE EAST SIDE OF PORTLAND STREET AND <br />PROVIDING AN EFFECTIVE DATE AND A POTENTIAL <br />REPEAL DATE AS OF JUNE 7,1999. <br />The City Council of the City of Eugene finds that: <br />Qn the 9th day of November,1998, the City Council of the City of Eugene by Motion duly <br />passed, called a public hearing to be held at 7:3 ~ p.m., Pacific Time on the 7th day of December, <br />1998, at the Council Chambers at City Hall, Eugene, Qregon, at which time and place protests and <br />remonstrances could be heard as to the proposed Council initiated vacation, with the consent of the <br />abutting property owners, of the following described portions of street right-of way. <br />The cul-de-sac located on the east side of Portland Street, south of <br />31St Avenue, Tax Lots 12204 and 12205, Assessor's Map 18-43-07- <br />11,more particularly described in Exhibit A attached hereto. City of <br />Eugene, SV 98-5}. <br />Reserving herein a public utility easement as more particularly set <br />forth in Exhibit B attached hereto. <br />THE CITY OF EUGENE DUES ORDAIN AS FOLLOWS: <br />Section 1. The City Council of the City of Eugene f nds that due and regular notice of the <br />hearing was published and pasted as by law required, and no valid objections were made at the <br />hearing or filed. The proposed vacation will not substantially affect the market value of the property <br />abutting the above-described portions of street right-af way and the public interest will not be <br />prejudiced by the vacation of the portions of street right-of way. The hearing was held on the 7th <br />day of December, 1998, at 7:30 p.m., Pacific Time, at the Council Chambers, City Hall, Eugene, <br />Lane County, Qregan, and all matters necessary to be done in the premises have been duly and <br />regularly completed. <br />ORDINANCE -1 <br />
