ORDINANCE NO. O <br />A ORDINANCE AUTHORIZING THE INSTITUTION OF <br />PROCEEDINGS IN EMINENT DOMAIN FOR THE <br />ACQUISITION OF PROPERTY INTERESTS FOR THE <br />LOWER AMAZON ENVIRONMENTAL RESTORATION <br />PROJECT (JOB#3531) <br />The City Council of the City of Eugene finds that: <br />A. The City Council has authority under provisions of the City Charter and applicable <br />state law to institute proceedings in eminent domain for the acquisition by condemnation of private <br />property for public purposes, including environmental restoration projects. <br />B. The City of Eugene is in the process of cooperating with federal agencies with respect <br />to the Lower Amazon Environmental Restoratian Praject which will result in: removing levees alon <br />g <br />a reach of the Amazon Channel and associated drainage channels; restoring high frequency flooding <br />to adjacent disturbed agricultural lands; restoring modified areas to native wet prairie vegetation; and <br />relocating levees and water control structures to the margins of the restored wetland areas. <br />C. The proposed project is in compliance with and in furtherance of adopted City plans <br />and policies, and necessary in arder to mitigate the detrimental effects of the original flood protection <br />projects of the Corps and NRCS, and to restore habitat and other environmental values associated <br />with wetlands in the Amazon Creek basin. This project will~restore a portion of the vast acres of <br />wetland habitat which once existed in the Willamette valley, but has been lost due to urban growth <br />and agricultural activities. The original flood protection projects directly contributed to the <br />degradation of water quality and wetlands in the lower Amazon Creek basin, and led to the decrease <br />in number and diversity of plant and wildlife species they ~ supported. <br />D. The public good realized from the project far outweighs any damage which the <br />property owners might sustain, particularly in light of the City's obligation to provide just <br />compensation to the affected property owners. <br />Now, therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOVYS: <br />Section 1. Based upon the above Endings, which are incorporated herein by reference and <br />hereby adopted, the City Council of the City of Eugene does hereby find, declare, and determine it <br />necessary to acquire certain ownership interests to the parcels of real property more particularly <br />described on Exhibit A attached hereto and incorporated herein by reference in order to acquire land <br />necessary for the Lower Amazon Environmental Restoration Project, which consists of removing <br />Ordinance ~ 1 <br />
