Parties list for the proposed refinement plan amendment and zone change. <br />J. The Eugene City Council held a public hearing on the request on November 22,1999, <br />and is now ready to take action on the requested amendment. <br />K. Evidence exists within the record and the findings attached hereto that the proposal <br />meets the requirements of Chapter 9 of the Eugene Cade,1971, and the requirements of applicable <br />state and local law. <br />NOW, THEREFORE, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The above findings, and the findings set forth in Exhibit B attached hereto and <br />incorporated herein by reference are adopted. <br />Section 2. The JeffersonlFar West Refinement Plan land use designation for the property <br />identified as tax lots 11744 and 11800, map 17-03-31-42, is amended from Public Facilities and <br />Open Space to Commercial as depicted on Exhibit A attached hereto and incorporated herein by <br />reference. <br />Section 3. The zoning for the property identified as tax lots 11700 and 11500, map 17- <br />03-31-42, is amended from PL Public Land to C-2 General Commercial, as depicted on Exhibit A <br />attached hereto and incorporated herein by this reference. <br />Section 4. Yf any section, subsection, sentence, clause, phrase, or portion of this <br />ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, <br />that portion shall be deemed a separate, distinct, and independent provision and that holding shall <br />not affect the validity of the remaining portions of this ordinance. <br />Passed by the City Council this <br />22nd day of November,1999 <br />,~ - ~~ <br />City Recorder <br />Approved by the Mayor this <br />22nd day of November, 1999 <br />./ <br />Mayor <br />ordinance - 2 <br />
