<br />ADMINISTRATIVE ORDER NO. 21-99-02 <br />of the <br />City Manager <br />City of Eugene, Oregon <br /> <br />Delegating Authority to Accept Real Property or <br />Interest in Real Property to the City Recorder. <br /> <br />The City Manager of the City of Eugene finds that: <br /> <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 1976, the <br />City Manager is designated as the administrative head of the City, and is specifically authorized to <br />appoint and remove all employees (except as otherwise provided in the Charter), and to enforce all <br />ordinances of the City. <br /> <br />B. Newly enacted provisions of Oregon Revised Statutes (HB 3581), requires that any <br />instrument conveying "title or interest" in property to the City must have the City's acceptance of <br />the conveyance endorsed thereon before it will be accepted for recording. As business agent for the <br />City for property transactions under the Charter, and pursuant to provisions of the Eugene Code, <br />1971, I currently have authority to note the City's acceptance on such documents. <br /> <br />C. The City Recorder is the custodian of the records of the City, and it would be in the <br />public interest and consistent with current practices of approving documents for recording that the <br />authorization to note the City's acceptance on documents conveying "title or interest" in property <br />be delegated to the City Recorder. <br /> <br />D. The City Recorder should also be specifically authorized to delegate all or any of the <br />duties or responsibilities delegated herein upon a determination it would be more efficient and in the <br />public interest to do so. <br /> <br />NOW, THEREFORE, <br /> <br />THE CITY MANAGER OF THE CITY OF EUGENE ORDERS AND DIRECTS <br />THAT: <br /> <br />1. Based on the above findings, which are hereby adopted, the authority to endorse the <br />City's acceptance on a document conveying "title or interest" in property to the City is hereby <br />delegated to the City Recorder. The City Recorder is authorized to note the approval by stamping <br />or writing on the document, "Accepted by the City of Eugene." <br /> <br />Administrative Order - 1 <br />
