ADMINISTRATIVE ORDER NO. 21-99-02 of the City Manager City of Eugene, Oregon Delegating Authority to Accept Real Property or Interest in Real Property to the City Recorder. The City Manager of the City of Eugene finds that: A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 1976, the City Manager is designated as the administrative head of the City, and is specifically authorized to appoint and remove all employees (except as otherwise provided in the Charter), and to enforce all ordinances of the City. B. Newly enacted provisions of Oregon Revised Statutes (HB 3581), requires that any instrument conveying "title or interest" in property to the City must have the City's acceptance of the conveyance endorsed thereon before it will be accepted for recording. As business agent for the City for property transactions under the Charter, and pursuant to provisions of the Eugene Code, 1971, I currently have authority to note the City's acceptance on such documents. C. The City Recorder is the custodian of the records of the City, and it would be in the public interest and consistent with current practices of approving documents for recording that the authorization to note the City's acceptance on documents conveying "title or interest" in property be delegated to the City Recorder. D. The City Recorder should also be specifically authorized to delegate all or any of the duties or responsibilities delegated herein upon a determination it would be more efficient and in the public interest to do so. NOW, THEREFORE, THE CITY MANAGER OF THE CITY OF EUGENE ORDERS AND DIRECTS THAT: 1. Based on the above findings, which are hereby adopted, the authority to endorse the City's acceptance on a document conveying "title or interest" in property to the City is hereby delegated to the City Recorder. The City Recorder is authorized to note the approval by stamping or writing on the document, "Accepted by the City of Eugene." Administrative Order - 1
