<br />ADMINISTRATIVE ORDER NO. 44-94-03 <br />of the <br />City Manager of the City of Eugene <br /> <br />Approving and Adopting <br />The United States Conference of Mayors (USCM) <br />Deferred Compensation Program <br /> <br />The City Manager of the City of Eugene finds that: <br /> <br />A. The City Council of the City of Eugene has previously determined that the <br />establishment of a Deferred Compensation Plan for its employees was beneficial for the <br />City, and authorized the City Manager to enter into such contracts or agreements as <br />necessary to implement such a program. <br /> <br />B. The United States Conference of Mayors (USCM) has established a master <br />prototype deferred compensation program for cities and political subdivisions that permits <br />its member cities and their employees to enjoy the advantages of this program, at no cost <br />to the City. It would be in the best interests of the City's employees to add this additional <br />deferred compensation carrier to the City's two currently established deferred compensation <br />carriers. <br /> <br />C. The USCM, as Plan Administrator, agrees to hold harmless and indemnify the <br />City, its appointed and elected officers and participating employees from any loss resulting <br />from the USCM's or its agent's failure to perform its duties and services pursuant to the <br />USCM program. <br /> <br />Now, therefore, based upon the above findings, <br /> <br />The City Manager of the City of Eugene orders that: <br /> <br />1. The U. S. Conference of Mayors Deferred Compensation Program and its <br />attendant investment options are hereby adopted, and added as an additional Deferred <br />Compensation Plan for the voluntary participation of all eligible City of Eugene employees. <br /> <br />2. Except as such authority is delegated in writing, the City Manager shall execute <br />for the City, individual participation agreements with each employee requesting the same, <br />act as Administrator of the Plan representing the City, and execute such agreements and <br />contracts as are necessary to implement the Program. <br /> <br />3.
