ORDINANCE N0. 19693 <br />AN ORDINANCE CONCERNING SKATEBOARDS, AMENDING 5.450 OF <br />THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 5.450 of the Eugene Code, 1971, is amended to pro- <br />vide: <br />5.450 Skateboards. <br />~1} As used in this section, a "skateboard" means a board of any <br />material natural or synthetic with wheels affixed to the underside, designed <br />to be ridden by a persan and propelled by human power. <br />~~} No person shall ride a skateboard: <br />~a} On any sidewalk within the area bounded by the western <br />sidewalk along Charnelton Street between Sth Avenue and 11th Ave- <br />nue, the northern sidewalk along 8th Avenue from Oak Street to <br />Charnelton Street, the eastern sidewalk along oak Street between <br />Sth and 11th Avenues, and the southern sidewalk along 11th Avenue <br />between Oak and Charnelton Streets, ar on either side of Willamette <br />Street between 8th and 7th Avenues, or in the area between the <br />Eugene Conference Center and the Hult Center. <br />fib} In any multi-level parking facility within the city, <br />~c} Within ten feet of any major bus transfer station. <br />~d} In the portion of a street designated for automobi]e <br />traffic, except when crossing a street in a crosswalk or at a <br />right angle. <br />~3} A person commits the offense of unsafe operation of a skate- <br />board on the sidewalk i f the person does any of the fol 1 owi ng ; <br />~ a} Rides a s kateboard upon a s i dewal k where prohibited; <br />~ b} Rides a s katebaard upon a s i dewal k where not otherwise <br />prohibited and does not yield the right of way to all pedestrians <br />an the sidewalk; or <br />~c} Rides a skateboard on a sidewalk in a careless manner <br />that endangers or would be likely to endanger any person or prop- <br />erty. <br />Section 2. That the matters contained herein concern the public welfare <br />and safety and therefore, an emergency is hereby declared to exist, and this <br />Ordinance shal 1 become effective immediately upon its passage by the City <br />Council and approval by the Mayor, retention by the Mayor for more than ten <br />Ordinance - 1 <br />
