ORDINANCE NO, 19701 <br />AN ORDINANCE CONCERNING LIQUOR LICENSE APPLICATIONS; <br />AMENDING SECTION 2.1100 OF THE EUGENE CODE, 1911; AND <br />DECLARING AN EMERGENCY. <br />THE CITY DF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 2.1100 of the Eugene Cade, 1971, is amended to pro- <br />vide: <br />2.1100 Li uor license A l ications - local Review b Cit Mana er. <br />~1} The city manager or designee is authorized to exercise the <br />authority granted the city council in ORS 411.2103}, 411.2104} and 412.120. <br />When making the recommendation to the Oregon liquor Control Commission, the <br />city manager or designee shall review the application for compliance with <br />the provisions of this cede and ORS Chapters 411 and 412. <br />~2} Whenever the city manager or designee recommends denial of an <br />appl~catian or, if the request is received before a recommendation is made, <br />upon written request of an interested person, the city manager or designee <br />shall state the reasons for his or her recommendati an and cause written <br />not ice of the decision to be sent to the applicant and the requestor. The <br />written notice shal 1 be hand delivered or sent by certi f ~ ed mai ] and shall <br />also advise the recipient of the provisions of subsection ~3} of this section. <br />~3} Any person aggrieved by the recommendation of the city manager <br />or des ~ gnee shal 1 w~ th ~ n 15 days of the date of the recommendation f i 1 e h i s <br />or her objections thereto in writing with the city manager for consideration <br />by a,hearings official. The provisions of section 3.060 shall govern the <br />hearing. <br />~4} In exercising the authority granted to the city council in <br />ORS 471;2104}, the city manager shall adopt such rules as may be necessary <br />by ut~ 1 i z~ ng the procedure set forth ~ n section 3.012 of this code. <br />Section 2.
