Existin shade. Non-exempt trees at least 30 <br />feet tall and more than six inches in diameter measured <br />four feet above the ground have a crown cover over at <br />1 east 80 percent of the lot and at 1 east 50 percent of <br />the crown cover will remain after development of the lat. <br />The applicant can show such crown cover exists by using <br />a scaled survey of non-exempt trees on the site ar by <br />using an aerial photograph. <br />~~} Shade from non-exempt trees is assumed to <br />remain if the trees are: situated in a required <br />setback; or part of an existing ar proposed park, <br />open space, or recreational amenity; or part of <br />landscaping or other features required pursuant to <br />this code; and they do not need to be removed for a <br />driveway ar other development . <br />~~} Also, to the extent the shade i s caused by <br />on-site trees or off-site trees an land owned by the <br />applicant, i t i s assumed to remain i f the applicant <br />files in the office of the county recorder a coven- <br />ant binding the applicant to retain the trees caul - <br />i ng the shade on the affected 1 ots . <br />fi. ye~etat~,vn__removal.
