ORDINANCE No. 7z Z <br />AN ORDINANCE DECLARING AN EFFECTIVE DATE FOR <br />ORDINANCE N0. 19719 CONCERNING AN <br />ADMINISTRATIVE CIVIL PENALTY AND THE <br />ADMINISTRATIVE CODE; AND DECLARING AN <br />EMERGENCY. <br />Recitals: <br />F A. Upon conclusion of the public hearing held before the <br />City Council on October 8, 1990, the Council unanimously approved <br />ordinance No. 19719 concerning an Administrative Civil Penalty and <br />the Administrative Code. Although a quorum of five Councilors was <br />present at the meeting, and all voted to adopt the ordinance, under <br />provisions of the City Charter an affirmative vote of two-thirds <br />of the members of the Council is required to enact an emergency <br />clause rendering the Ordinance immediately effective. <br />B. A similar vote of two_thirds of all members of the <br />Council is required to enact subsection ~11~ of Section 2.018 as <br />set forth in Ordinance No. 19719, which subsection amends the <br />City's lien procedures. <br />C. It is the Council's intent that Subsection X11} of <br />Section 2.418 be adopted, and that Ordinance No. 19719 become <br />immediately effective, as proposed in the original Council Bill. <br />NOW, THEREFORE, <br />THE CITY OF EUGENE DOES oRDAIN AS FOLLOWS: <br />Section 1. The Council hereby reaffirms and ratifies the <br />adoption of Subsection filly of Section 2.018 of the Eugene Code, <br />1971 as set forth in Ordinance No. 19719 passed by the Council and <br />approved by the Mayor on October 8, 1990. <br />Section 2. That the matters contained herein concern the <br />public welfare and safety and therefore, an emergency is hereby <br />declared to exist, and this ordinance, and ordinance No. 19719 <br />shall become effective immediately upon the passage of this <br />Ordinance by the City Council and approval by the Mayor, retention <br />by the Mayor far more than ten days, or readoption over a mayoral <br />veto by a majority of all Councilors, except that Subsection ~11~ <br />of Section 2.x18 of the Eugene Code, 1971, as adopted in Ordinance <br />Nv. 19719 and ratified herein, shall became effective six months <br />after the effective date of this Ordinance. <br />Passed by the City Council this <br />17t day of October, 1990 <br />City Rec der <br />Approved by the Mayor this <br />17th day Octobe 1 90 <br />__ <br />or <br />F- <br />
