ORDINANCE N0. IGt~ (off <br />AN ORDINANCE LEVYING ASSESSMENTS FOR <br />PAVING, SANITARY AND STORM SEWERS FOR REGENCY WEST SUBDIVISION, THE <br />EXTENSION OF MARTINGALE STREET NORTH AND WEST A DISTANCE 525-FEET <br />AND THORNBERRY STREET 350-FEET SOUTH FROM WILLAKENZIE ROAD; <br />DECLARING AN EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />On the 1st day of May, 1990, as authorized in the Eugene Cade 7.1b0 8 the <br />~3 <br />City Engineer initiated the proposed local improvement consistin of avin <br />g p gf _ <br />sanitary and storm sewers from Regency West Subdivision, the extension of <br />Martingale Street north and west a distance 625-feet and Thornberry Street 350- <br />r <br />feet south from Willakenzie Road. <br />After due notice and a publ i c hearing thereon before the hearing official , <br />and no remonstrances having been filed, an the 8th day of august, 1994, the City <br />Counci 1 farmed the 1 ocal improvement district and authorized canstructi on of the <br />local improvement. <br />The actual cost of the local improvement is ascertained to be <br />$156,221.bb and the amounts to be assessed to and borne b the sec' <br />y p pally <br />benefitted property and to be borne by the Cit or others has been determined <br />Y <br />in accordance with applicable provisions of the Eugene Code, 1971 and as set <br />forth in items 1 to 13 from Page 1 an Exhibit a attached hereto and incor- <br />porated herein by reference. ' <br />The City Counci 1 has established the method of cal cui ati ng l acal improve- <br />ment assessments in Sections 7.170 and 7.115 of the Eugene Cade, 1911. <br />A notice containing the information required by Section 7.185 of the <br />Eugene Code, 1971 has been posted on a bulletin board at City Hall and given by <br />certified mail to the owners of the parcels of real property subject to the <br />assessment more than ten days prior to the public heari n~g before the hearing <br />ORDINANCE - 2 <br />
