The hearing shall <br />conform with the notice, hearing, and decision require- <br />ments of the original application process, as provided <br />in sections 9.512 ~4} to ~8} of this code. The hearings <br />official may deny, modify, or approve the modification <br />request. Approval of a major modification shall re- <br />qui re a f i ndi ng by the hearings official that the pro- <br />posal and modification meet the applicable criteria set <br />out in section 9.5125} of this code. Whether or not a <br />public hearing is held, notice of the hearings official's <br />decision shall be provided i n accordance with section <br />9,512~fi} of this code. The decision of the hearings <br />official may be appealed to the planning commission wi th- <br />in the time and subject to the process set out in subsec- <br />tions 9.5129} and X10} of this code. <br />Sect i an 39 . Section 9.520 of the Eugene Code, 1911, i s repealed . <br />Section 40. Subsections (4)(a) and (b) and (7) of Section 9.535 of the <br />Eugene Code, 1911, are amended to provide <br />9.535 Solar Setback Standards . <br />4} Solar setback standard.
