ORDINANCE NO. ~y~~~ <br />An ordinance vacating the following described alley, to- <br />wit: <br />All that portion of the 14.00 foot wide alley in Block <br />10, of the Plat of Eugene City as recorded in Judgment <br />Docket A, Page 122, Lane County Oregon Plat Records, <br />lying North of a line between the Southeast corner of <br />Lot 3 of said Block and the Southwest corner of Lot 4 <br />of said Block. ~AV 89-002 City of Eugene <br />RESERVING HEREIN an easement for public utility <br />purposes over, under, and across the above described <br />property, and the right tv enter thereon for purposes <br />of construction, reconstructive, repair and <br />maintenance. The easement herein reserved shall <br />include all land and space in the area above described, <br />situated and being below a horizontal plane at <br />elevation 438.00 feet, as determined from City of <br />Eugene Metro Bench Mark No. 318, elevation 421.80 feet, <br />a 1-1/8" brass cap embedded in the sidewalk at the <br />northwest corner of 8th Avenue and olive Street. <br />on the 20th day of September, 1989, the City Council of the <br />City of Eugene by Motion duly passed, called a public hearing to <br />be held at 7:3D p.m., Pacific Time on the 23rd day of Uctober, <br />1989, at the Council Chambers at City Hall, Eugene, Oregon, at <br />which time and place pretests and remonstrances could be heard as <br />to the proposed vacation of the above described alley. <br />Notice was duly and regularly given of the hearing and at <br />said time and place the Council heard all objections to the <br />proposed vacation. <br />All persons awning property abutting the alley to be vacated <br />have consented to the vacation and applied for the same. <br />THE CITY of EUGENE DQES ORDAIN AS FOLLOWS: <br />Section 1.
