ORDINANCE NO. ~y~~~ An ordinance vacating the following described alley, to- wit: All that portion of the 14.00 foot wide alley in Block 10, of the Plat of Eugene City as recorded in Judgment Docket A, Page 122, Lane County Oregon Plat Records, lying North of a line between the Southeast corner of Lot 3 of said Block and the Southwest corner of Lot 4 of said Block. ~AV 89-002 City of Eugene RESERVING HEREIN an easement for public utility purposes over, under, and across the above described property, and the right tv enter thereon for purposes of construction, reconstructive, repair and maintenance. The easement herein reserved shall include all land and space in the area above described, situated and being below a horizontal plane at elevation 438.00 feet, as determined from City of Eugene Metro Bench Mark No. 318, elevation 421.80 feet, a 1-1/8" brass cap embedded in the sidewalk at the northwest corner of 8th Avenue and olive Street. on the 20th day of September, 1989, the City Council of the City of Eugene by Motion duly passed, called a public hearing to be held at 7:3D p.m., Pacific Time on the 23rd day of Uctober, 1989, at the Council Chambers at City Hall, Eugene, Oregon, at which time and place pretests and remonstrances could be heard as to the proposed vacation of the above described alley. Notice was duly and regularly given of the hearing and at said time and place the Council heard all objections to the proposed vacation. All persons awning property abutting the alley to be vacated have consented to the vacation and applied for the same. THE CITY of EUGENE DQES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Eugene finds that due and regular notice of the hearing was published and ordinance - 1
