Swenson EPD-ADM 1/19/2009 Pri 3 No No Support <br />Comments: <br />We support this bill. <br />Sections 1 and 2 of the bill provide that information which is part of investigations being <br />conducted by DPSST (generally on the fitness of police officers, firefighters, or <br />paramedics to maintain certification) be confidential until the investigation is complete, <br />and a final report is issued. We support this, because it is in many cases necessary to <br />keep such information confidential during an investigation to keep from compromising the <br />investigation. <br />Section 3 provides that records provided to DPSST for such an investigation which were <br />already confidential will retain that confidentiality, both during and after the investigation. <br />We support this because there was already a legal basis for the confidentiality of the <br />information, and that should not change simply because the information was used as part <br />of an investigation. If this provision is not there, one of two results will occur: either <br />DPSST will not get the information it needs to conduct the investigation because the <br />holder of the information does not want to compromise its confidentiality, or the <br />information will lose the confidentiality which it already had simply because it was needed <br />for an investigation. <br />9 <br /> <br />
