as follows: $0.52 to the State General Fund, $0.59 to the Oregon Health Plan, $0.02 to <br />cities, $0.02 to counties, $0.02 to the Oregon Department of Transportation for <br />transportation services to the elderly and disabled, and $0.01 to the Tobacco Use <br />Reduction Account. <br />323.030 Tax imposed; rate; exclusiveness; only one distribution taxed. (1) Every distributor <br />shall pay a tax upon distributions of cigarettes at the rate of 29 mills for the distribution of <br />each cigarette in this state. <br />323.455 Distribution of certain cigarette tax revenues. (1) All moneys received by the <br />Department of Revenue from the tax imposed by ORS 323.030 (1) shall be paid over to the <br />State Treasurer to be held in a suspense account established under ORS 293.445. After <br />the payment of refunds, 89.65 percent shall be credited to the General Fund, 3.45 percent <br />is appropriated to the cities of this state, 3.45 percent is appropriated to the counties of this <br />state and 3.45 percent is continuously appropriated to the Department of Transportation for <br />the purpose of financing and improving transportation services for elderly individuals and <br />individuals with disabilities as provided in ORS 391.800 to 391.830. <br />323.031 Additional tax imposed; rate. (1) Notwithstanding ORS 323.030 (2) and in addition <br />to and not in lieu of any other tax, every distributor shall pay a tax upon distributions of <br />cigarettes at the rate of 30 mills for the distribution of each cigarette in this state. <br />323.457 Distribution of additional tax proceeds. (1) Moneys received under ORS 323.031 <br />shall be paid over to the State Treasurer to be held in a suspense account established <br />under ORS 293.445. After the payment of refunds: <br />(a) 29.37/30 of the moneys shall be credited to the Oregon Health Plan Fund established <br />under ORS 414.109; <br />(b) 0.14/30 of the moneys are continuously appropriated to the Oregon Department of <br />Administrative Services for distribution to the cities of this state; <br />(c) 0.14/30 of the moneys are continuously appropriated to the Oregon Department of <br />Administrative Services for distribution to the counties of this state; <br />(d) 0.14/30 of the moneys are continuously appropriated to the Department of <br />Transportation to be distributed and transferred to the Elderly and Disabled Special <br />Transportation Fund established under ORS 391.800; and <br />(e) 0.21/30 of the moneys shall be credited to the Tobacco Use Reduction Account <br />established under ORS 431.832. <br />HB 2141 <br />Relating Clause: Relating to hazardous substances. <br />Title: <br />Expands definition of 'hazardous substance' to include substances that pose risk to public <br />health and safety because of irreversible harm or chronic adverse health effects. Requires <br />Director of Human Services to adopt standards for labeling products that contain hazardous <br />substances.
