~r~in~an~ce ~ 35 <br />~3} In the R-~3 district there shall be a minimum of 1,ZD0 square <br />feet of lot area per dwelling unit for multiple family uses. Campus living <br />organizations and all other residential buildings and uses permitted, except <br />single family and duplex, shall have at least 4DD square feet of lot or <br />development site area for each bed contained therein or each occupant, <br />whichever number is greater. <br />~4} In the R-4 district there shall be a minimum of 400 square <br />feet of lot ar development area per dwelling unit for multiple family uses, <br />Campus living organizations, boarding or rooming houses and all other resi- <br />dential buildings and uses permitted, except single family and duplex, shall <br />have at least ZDO square feet of lot or development site area for each bed <br />contained therein or each occupant, whichever number is greater. <br />~5} In the GO district, the minimum lot or development site area <br />required per dwelling unit shall be the same as the area required in the <br />R-Z district. <br />section 3D. Section 9.548 of the Eugene Code, 197I, is hereby <br />repealed. <br />Section 31. Section 9.55D of the Eugene Cvde, 197I, is hereby amended <br />to read and provide: <br />9.55o Cluster subdivisions in RA and R-I Districts. ~n RA and R-1 <br />districts, the lot area, lot coverage, and yard requirements may <br />be relaxed i n connection with i ndi vi dual 1 ots or bui 1 di ng sites created by <br />duly approved, filed, and recorded subdivisions of the "cluster" type <br />provided that: <br />~a} Approval of the proposed development plan is granted by <br />the planning director according to the procedures set forth in <br />sections 9.69D to 9.694, using the criteria contained in section <br />9.688~b} , and notice provisions as required i n connection with a <br />land division variance request, and <br />fib} The difference in square footage between the minimum <br />lot area per dwelling unit required by district or subdistrict <br />and the square footage of actual dwelling unit lots created is <br />designated as a separately recorded lots} and is secured and <br />maintained by a covenant ar asssociatian, approved by the office <br />of the city attorney, as semi-private open space for use of all <br />occupants of the subdivision or anti 1 dissolution i s approved by <br />the planning and public works directors, and <br />(c} Maximum density, defined for this section as total <br />dwelling units divided into the total area included in the appli- <br />cation, does not exceed that permitted by the district or subdis- <br />trict in which the subdivision is to be located, taking into <br />account the special standards in section 9.386 for duplex, tri- <br />plex, and fourplex developments. A performance agreement, <br />approved by the office of the city attorney, binding the applicant <br />and the applicant's successors in interest shall be required. In <br />
