fib} Commercial pursuits. <br />~c} Placing a display or allowing a display in one`s charge <br />to remain. <br />~d} Conduct ar participation in the conduct of a dance. <br />fie} Conduct, presentation, or participation in the conduct <br />or presentation of entertainment of a musical, theatrical, cine- <br />matic, choreographic, or athletic character that attracts at any <br />one time an audience of more than Z5 persons. <br />~f} Conduct or participation in the conduct of a meeting <br />that attracts at any one time an assembly of more than Z5 persons. <br />fig} Electrical amplification of sound. <br />~Z} Except for city vehicles and other publicly awned emergency <br />vehicles, no person shall operate or parka motor vehicle on the mall without <br />first obtaining a permit issued by the director. <br />4.811' Pedestrian Mall - Permits. <br />~1} A mall~actvity permit for an activity requiring a permit may <br />be obtained as follows: <br />~a} Application for the permit shall be filed with the <br />director an a farm supplied by the director. <br />fib} The application may not be filed earlier than Z1 nor <br />later than seven days before the date set for the activity, unless <br />the di rector .finds that earlier or later filing of the application <br />is necessary in the interests of the applicant and the city. If <br />the filing is later than seven days before the date set far the <br />activity, the applicant shall have no right of appeal. <br />~c} A copy of the application shall be posted promptly on a <br />bulletin board i n the mat 1 and 1 eft there anti 1 the desired permi t <br />has been granted or denied. <br />~d} ~f the permit applied for i s for commercial display or <br />sale of goads or services, the director shall determine within 15 <br />days whether to issue the permit and, if issuing it, whether to <br />condition it in accordance with subsection ~3} of this section. <br />fie} If the permi t applied for i s not for commercial display <br />or sale of goods or services, within 16 regular city office hours <br />after the filing of the application the director shall determine <br />whether the permit shall be issued and whether to condition it in <br />accordance with subsection ~3} of this section. <br />~f} Application fora permit to carry on in the mall any <br />activity referred to in section 4.876 that constitutes a constitu- <br />tional right shall be granted unless it interferes with another <br />scheduled permitted activity. Exercise of the right may take <br />place only in the area of the mall indicated by the permit and <br />only in accordance with reasonable conditions specified pursuant <br />to this section. <br />fig} A party aggrieved by the issuance or denial of a mall- <br />activity permit under this subsection may within 16 regular city <br />office hours after that action appeal to the city manager ar his <br />or her designee. Notice of the appeal shall be filed at once with <br />the director and shall suspend the permit until the appeal is de- <br />cided.
