facilities of whatsoever nature, but it is agreed that such use shall not <br />interfere or compete with Grantee's use thereof. Grantor shall hold Grantee <br />harmless from any and all liability which may arise as a result of its use of <br />Grantee's poles or other installation. <br />~7~ E ui ment Maintenance. Grantee shall at all times keep and <br />maintain al 1 of its poles, fixtures , conduits, wires, and i is entire system i n <br />a good state of repair and shall indemnify and save harmless the Grantar of <br />and from any and all damages of any kind or character growing out of or aris- <br />ing by reason of Grantee's failure to so maintain the cable communications <br />system i n the franchise terri nary. <br />~ 8~ Tem arary Removal of Faci 1 i ti es . <br />~a~ Grantee shall at its expense protect, support, temporarily <br />disconnect, or relocate any of its equipment when required to do so by Grantor <br />by reason of traffic conditions, public safety, street vacation, freeway and <br />street construction, change or establishment of street grade, installation of <br />sewers, drains, water pipes, paver lines, signal lines, and tracks, or any <br />other type of structures or improvements by the Grantor or such duly estab- <br />lished utility boards as the Eugene mater & Electric Board or the Springfield <br />Utility Baard. <br />~b~ Grantee shall, within ? days of written request of any <br />person holding an appropriate permit issued by the Grantar, temporarily raise <br />or lower its lines or other equipment to permit the moving of any building ar <br />ather structure, machinery, or object, and the actual expense of the same <br />shall be paid by the person making the request. The person making the re- <br />quest will indemnify and save harmless said Grantee of any and all damages <br />or claims of whatsover kind or nature caused directly or indirectly from such <br />temporary rearrangement of the equipment of the Grantee and, if required by <br />Grantee, shall provide a cash deposit or a goad and sufficient bond to pay <br />any and all such costs as estimated by Grantee. <br />Grdinance ~ 15 <br />
