~_ <br />fair value of the system, the original cost of all tangible and intangible <br />property, as we11 as the salvage value, the book value, the replacement costs, <br />cash flow, and other factors may be considered. <br />~ 7} Di s osi ti an of Faci 1 i ti es . <br />~a} Upon expiration or termination of the franchise, the <br />Grantee, upon request of the Grantor, shall promptly remove all of its equip- <br />ment above ground in the public right-of-~way. <br />fib} In removing its equipment, the Grantee shall refill, at <br />its own expense, any excavation that shall be made by it and shall leave all <br />public ways and places in as good condition as that prevailing prior to the <br />Grantee`s removal of its equipment and appliances, without affecting the <br />electric or telephone cables, wires, or attachments. Such restoration of <br />property shall not be considered completed until the Grantor has inspected <br />and approved the condition of the public ways and places. The liability in- <br />surance and indemnity as provided under Section lI herein sha11 continue in <br />fu11 force and effect during the period of removal. <br />(c~ In the event of a failure by the Grantee to complete any <br />work required by Subsection ~a} above or any work required by law ar ordi- <br />nance within the time as may be established by the Grantor or to the satis- <br />faction of the Grantor, the Grantor may cause such work to be done and the <br />Grantee sha11 reimburse the Grantor the casts thereof within 3D days after <br />receipt of an itemised list of such costs, or the Grantor may recover such <br />costs as provided in Section 11. <br />Section 18. Payment,,,,, of Litigation ,Costs. The nanprevailing party in <br />any litigation sha11 reimburse to the other all costs including filing fees, <br />costs of depositions, discovery, expert witnesses, al 1 other expenses of <br />suit, and reasonable attorney fees. <br />Grdinance - 34 <br />
