of Grantee within 10 days, it shall be sufficient if Grantee initiates all <br />reasonable measures to cure the violation within ~D days and continues there- <br />after with all reasonable dispatch to cure the violation; provided, in any <br />event the violation must be cured not later than 60 days after notice is <br />given. Notice shall be directed to the general manager of Grantee's Eugene <br />office. Amended by Ordinance No. X9359, 1d/~4/85.~ <br />Section ~0. Remedies Not Exclusive. All remedies and penalties under <br />this ordinance, including termination of the franchise, are cumulative, and <br />the recovery or enforcement of one is not a bar to the recovery or enf~rce- <br />ment of any other such remedy ar penalty. The remedies and penalties captain- <br />ed in this ordinance, including termination of the franchise, are not exclu- <br />sive, and the Grantor reserves the right to enforce the penal provisions of <br />any ordinance or resolution and to avail itself of any and all remedies avail- <br />able at law or in equity. Failure to enforce shall not be construed as a <br />waiver of any term, condition, or obligation imposed upon the Grantee pursu- <br />ant to this ordinance. A specific waiver of a particular term, condition, or <br />obligation imposed upon Grantee by or pursuant to this ordinance shall not <br />be a waiver of any other or subsequent ar future breach of the same ar of any <br />other term, condition or obligation itself . <br />section 2~. New Developments. The Grantor may amend this franchise <br />whenever necessary to enable the Grantee to take advantage of any developments <br />i n the f i el d of transmission of communication signals which wi 11 afford i t an <br />opportunity to serve more effectively, efficiently, or economically its cus- <br />tomers; provided, however, that this section shall not be construed to require <br />the Grantor to make any such amendment. For such an amendment to be effec- <br />tive, its terms must be unconditionally accepted by the Grantee in writing, <br />signed by an officer of the corporation within 30 days after the date the <br />amending ordinance is passed by Grantor.
