ORDINANCE NO. 20188

AN ORDINANCE ADOPTING THE 2000 HAZARDOUS SUBSTANCE
TRACKING INSTRUCTIONS.

The City Council of the City of Eugene finds that:

A.
Amendment IV to the Eugene Charter of 1976 was adopted at the general election on
November 5, 1996 (the Amendment). The Amendment provides in part that hazardous substance
A@
users in Eugene shall file an annual materials balance report that lists inputs and outputs of all
hazardous substances obtained, used or generated. By Ordinance No. 20112 adopted by the Council
and approved by the Mayor on April 6, 1998, and by Ordinance No. 20137 adopted by the Council
and approved by the Mayor on December 7, 1998, the City Council adopted the 1998 and 1999
Hazardous Substance Reporting Forms and Instructions, respectively.

B.
The Toxics Board has reviewed the 1998 and 1999 Instructions, and developed the
2000 Hazardous Substance Tracking Instructions for reports due April 1, 2001. The 2000
Instructions reflect certain policy refinements made to the reporting requirements by the Board during
1999, as well as changes to the program required by House Bill 2431, adopted by the Oregon
Legislature in the 1999 legislative session. These are explained on page ii at the beginning of the
A@
2000 instruction booklet.

C.
Like the 1998 and 1999 instructions, the 2000 Instructions also include numerous
provisions that simply describe explicit provisions of Amendment IV; some interpretations of the
Amendment; and some provisions that are necessary to implement the Amendment in a practicable
manner but which are not expressly contained in the Amendment. The Toxics Board has
recommended that the Council adopt the 2000 Instructions.

D.
The Council approves the 2000 Instructions as being consistent with the terms and
intent of Amendment IV and House Bill 2431 adopted by the Oregon Legislature in the 1999
legislative session. The Council intends by this ordinance to adopt the 2000 Instructions as binding
on those persons covered by its terms.

E.
The Council adopts this ordinance pursuant to its authority under both section 4 of the
Eugene Charter of 1976 and Article X of Amendment IV to the Charter.

THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:

2000 HAZARDOUS SUBSTANCE TRACKING INSTRUCTIONS
The , for reports due
April 1, 2001, prepared by the Toxics Board and a copy of which is attached hereto as Exhibit A, are
hereby adopted by the Council.

Passed by the City Council this Approved by the Mayor this

thth
28 day of February, 2000. 28 day of February, 2000.

/s/ Warren G. Wong /s/ James D. Torrey
City Recorder Mayor
