Section 5. Subsection ~5~ of Section 9.546 of the Eugene Code, 1911, is amended to read and provide: 9.546 Lot ar Deve1a ment Site Area Re uired Per Dwel1in Unit, (5~ In the GO district, the minimum lot or development site area required per dwelling unit sha11 be the same as the area required in the R-3 district. Section 6. Section 9.674 of the Eugene Cade, 1971, is amended to read and provide: 9.674 Decision and A eal Authority. If a zone change is for property proposed far annexation to the city, the planning commission shall recommend a city zoning district designation to the council in conjunction with the annexation, unless it denies the annexation. The city council shall act on planning commission recommendations for city zoning district designations i n conjunction with annexations and on appeals from commission denials. Except as otherwise provided in this section, the council shall follow the procedures in this chapter far annexations when considering city zoning district designations far properties also being considered for annexation. 1f a zone change only includes property already in the city, it shall be approved, modified and approved, ar denied by the hearings official. The planning commission shall act on appeals from decisions of the hearings official. Commission decisions are final. All final zoning district change decisions shall be by order which shall mandate in relevant cases that the zoning map established under section 9.274 of the Eugene Gode, 1971 be amended to reflect the allowed change of zoning district. Section 7. That the matters contained herein concern the public we1- fare and safety, and in order to insure the orderly implementation of the Ordinance - 3
