~ b} The credit rating of the city and its abi 1 i ty to retire <br />existing Bancroft band obl i gati ans using payments from the owners <br />of previously assessed property; <br />4 c} The 1 eve1 of petitioner's investment i n 1 ocal i mprove- <br />ments being constructed to serve the area; <br />~ d} The availability of private capital or other means to <br />finance 1oca1 improvements to undeveloped property; <br />~ e } The payment history of petitioners on other 1 ocal i mprove- <br />ment assessments; <br />~f} Any other factors the council deems significant, <br />~3 } Except as directed to the contrary by counci 1 poi i cy adapted <br />pursuant to subsection 7.160 ~~ } , under this section the city engineer shat 1 <br />not approve a peti ti on for construction of 1 ocal improvements to serve resi - <br />dentially zoned undeveloped property until the petitioner: <br />~ a} ~ s current on all obligations imposed by this chapter on <br />the petitioner and on real property i n which the petitioner hal ds <br />1 egal ti t1 a or an equitable interest; and <br />~ b} Provides the city engineer with reasonable assurance <br />that upon completion of the plans and specifications fvr the peti - <br />ti oned i mpravements, petitioner shat 1 deposit with the city finance <br />officer sufficient funds to keep the estimated assessments against <br />petitioner's real property equal to or less than the real prop- <br />erty's assessed value as determined by the Lane County Assessor. <br />~4} A person desiring to construct or to have a local improvement <br />constructed shal 1 first fi 1 e a peti ti an with the city engineer an farms pro- <br />vi ded by the city engineer, A peti ti on fora 1 ocal improvement to be con- <br />structed by the petitioner at the petitioner's expense may be approved by <br />the city engineer upon petitioner's compliance with the appl i cab] a provisions <br />of this chapter, The city engineer sha11 present to the counci ] petitions <br />for local improvements to be financed in any part by assessments against spe~ <br />dally benefitted property. Such petitions may be presented singly or in a <br />project group at the time requested by the petitioner, by the council or by <br />the city engineer, whichever first occurs, <br />~ 5 } The council , upon its own motion may initiate consideration <br />of a proposed local improvement. Local improvement projects are also initi- <br />ated for consideration under this section when the project i s included i n <br />the council approved capita] improvement plan, <br />~6} The city engineer, except when proceeding under subsection <br />7,160 ~ 7 }, fo11 owl ng i n7 ti ati on of cansi derati on shat 1 furnish the counci 1 a <br />report containing the following information and whatever additional informa- <br />tion the council requires: <br />~ a} A map shvwi ng the general nature, 1 ocati on, and extent <br />of the proposed local improvement and the contemplated district <br />within which 1 and would be assessed for the cost of the proposed <br />improvement, <br />~ b} A l i st of all parcels of land i n the district and of <br />their owners. <br />~d} An estimate of the total cost of the proposed improve- <br />ment wi th a breakdown showing the estimated amount and its percent- <br />age of the total estimate to be borne by any petitioner prior to <br />assessment, by local improvement assessments against specially <br />benefitted property, by the city and by any others. <br />t7} After considering a report furnished under subsection 7,1606}, <br />the counci 1 may: <br />Ordinance - 20 <br />
