requi red by the city engineer to protect the public health, safety and wel- <br />fare, <br />~ 4 ~ The city engineer shall adopt standard specifications for <br />work affecti ng a publ i c way. <br />~5~ Tf an applicant for a permit or the contractor performing the <br />work far the appi cant i s: <br />~ a} Delinquent i n performing the obligations requi red by sec- <br />ti ons 7.290 to 1.345 on permits previously issued, the city engi- <br />neer may refuse to issue a new permit far other work affecting a <br />public way unti 1 the delinquency i s corrected; and <br />~ b~ Has hi stori ca] ly been delinquent i n performing the ob1 i -~ <br />gati ons requi red by sections 7.290 to 1, 308, the city engineer <br />may requi re a band or other reasonable security be posted with the <br />city against which the city may collect its cost of enforcing thi s <br />code and the conditions of any permit issued thereunder against the <br />permittee, <br />7.295 Public Way Construction and Use -Permit App] i cati on. <br />n ess of erwi se perms tte ~ n sects on 1.305, application for <br />a permit to perform work affecti ng a publ i c way shall be made to the city <br />engineer on forms provided by himlher, The city engineer may waive the re- <br />qui rement to complete the application form and pay the permit fees and <br />restoration deposit when the amount of work to be done i n the public way <br />does not warrant the cost of processing the application and enforcement of <br />this chapter. <br />~ 2 ~ The city engineer may require such information i nc1 udi ng draw- <br />ings, surveys and plans as ~sl~he deems necessary to determine whether the <br />proposed work conforms to the requirements of this code . <br />~ 3 ~ T f the city engineer determines that i t i s proper that the <br />proposed work be done, the application shat 1 be approved, After approval , <br />and upon receipt of the requi red fee and deposit, the city engineer shal 1 <br />issue a revocable permit. <br />~4~ Tf the city engineer denies a permit, the applicant shall have <br />the right of appeal to the city manager as provided in section 3,050 of this <br />code. <br />7.291 Permit - Insurance Requirement; Safety. <br />o perrn~ t s a e ~ ssue un er section 1.295 unless an appi i - <br />cant agrees to save the city, its officers, employees and agents harmless <br />from any and all costs, damages and 1 i obi l i ti es which may accrue or be c1 ai m-~ <br />ed to accrue by reason of any work performed under said permit. The accept- <br />ance of a permi t under 7, 290 shall constitute such an agreement by the <br />applicant whether the same is expressed or not. <br />~2} A permittee shall preserve and protect from injury other per- <br />mittees' foci 1 i ti es i n the public way, the public using the public way and <br />any adjoining property, and take other necessary. measures to protect life <br />and property i nc1 udi ng but not limited to bui 1 di ngs, wa11 s, fences or uti l i - <br />ties that may be subject to damage from the permitted excavation. A per- <br />mi ttee shall be responsi b1 a for all damage to public or private property <br />resulting from its fai 1 ure to properly protect people and property and to <br />carry out the work. <br />Ordinance - 37 <br />
