unsafe, the traffic engineer may grant an exception to thi s <br />requirement, <br />~5} Upon application of the involved property owners, more than <br />one industrial development site may share a si ngi a curb cut i n I-1, I-2 <br />and ~-3 zones, upon a fi ndi ng by the traffic engineer that i t wi 11 resin t <br />in safe ingress and egress for users thereof and the general public, <br />7.445 Construction i n Public Right-of-Way. <br />e c~ ty manager ~ s out ors zed to i ssue a permi t for an over- <br />sized curb cut or a revocable permit for construction or location of a <br />retaining wall , steps, terracing, plantings, planters, walkways and other <br />appurtenances to be i nstal I ed wi thi n a publ i c street right-of-way at the <br />property owner's risk and subject to the fol 1 owl ng conditions and requi ce- <br />ments. <br />~a} Adequate plans and specifications for the proposed <br />instal 1 ati on are submitted to the city engineer. <br />~ b} Candi ti ons approved by the city engineer shat I be <br />attached to and made a part of the application and plans. <br />~ c} That the structures comply with the applicable codes <br />or ordinances of the city with regard to structural safety, <br />sani tati an and fire safety requirements, <br />~d} That the requests be evaluated by the city engineer <br />i n regard to any adverse effect on adjoining properties. <br />~ e} That there be no interference with the use of the <br />public street for roadway, walkway, existing or proposed <br />uti 1 i ti es and other authorized uses, <br />t f } That said permit shat 1 be revocable by the city on <br />demand except in the case of oversize curb cuts. <br />4 g} Al I plantings shat 1 be first approved by the <br />director of parks and recreation. <br />~h} The form of permit shall be approved by the city <br />attorney. <br />~i} A fee for the permit shall be charged to the <br />applicant based on the same va] uati ons of the work to be <br />performed i n the public right-of~-way as specified for bui 1 di ng <br />permits under applicable ordinances. <br />~ j} The applicant shat 1 agree to the foregoing <br />conditions for the approval of said permit. <br />~ 2 } The city manager i s au thvri zed to permit special si dewal k <br />surfaces over and above those al 1 owed i n the standard specifications for <br />paving; provided, however: <br />~ a} The surfacing has been approved by the city engineer <br />from the standpoint of non-skid requirements, <br />~ b} Blocks, bricks, and other sidewalk materials are <br />imbedded to prevent rocking or differential settlement. <br />~ c} The surfacing wi 11 be maintained by and at the <br />expense of the abutting property owner, <br />~ d} ~ f the surfacing proves hazardous i n the api ni on of <br />the city engineer, the surfacing wi I l be replaced with material <br />either meeting city specifications or approval. <br />Ordinance - 44 <br />
