~ 3 } The statement shall be referred to the hearings official . <br />The appellant sha 11 be given at least five days' prior written nati ce of the <br />time set to cansi der the abatement. The hearings official shall take oral <br />or written testimony at the time and place specified i n the notice . The <br />hearings official shat 1 prepare written findings of fact and concl usi ans of <br />law when determining whether a nuisance exists. The hearing officia]'s <br />determination shall be final . <br />~4 } ~ f the hearings of f i ci a1 determines that a nui sauce exists, a <br />person responsible shat l , within 10 days after the hearings official ' s deter- <br />minate on, or wi the n a time set by the hearings official , abate the nuisance. <br />6.090 Abatement Procedures - By the City. <br />~ w~ the n the t~ me allowed, the nuisance has not been abated <br />by a person responsible, the city manager, or the manager's.. designee may <br />cause the nuisance to be abated. <br />~2} The officer charged with abatement of the nuisance, or con- <br />tractors acting under the direction of the offi cer shat 1 have the right at <br />reasonable times to enter i nta or upon property i n accordance with 1 aw to <br />investigate or cause the removal of a nui sauce. <br />~3} The finance affi cer shall keep an accurate record of the <br />expense incurred by the city i n physical 1 y abating the nuisance and shat 1 <br />include therein a reasonable charge for administrative overhead. <br />6.100 Abatement Procedures -Assessment of Costs. <br />1 The finance officer, by registered or certified mai 1, postage <br />prepaid, sha11 forward to a person responsi b1 e a note ce stating <br />4 a } The total cost of abatement including the administrative <br />overhead. <br />~ b} That the cost as indicated will be assessed to and become <br />a 1 i en against the property unless paid within ten days from the <br />date of the notice. <br />~ c} That i f the person responsi b1 a objects to the cost of <br />the abatement as indicated, he may fi 1 e a wri tten notice of ob jec~- <br />ti on with the finance officer not more than 10 days from the date <br />of the notice . <br />~2 } The person responsi b1 e' s objection to the costs of abatement <br />shall be heard by a hearings official. The objector shall be given at least <br />five days' prior written notice of the time set to consider his or her ob jec- <br />tions. The hearings official shall take oral or written testimony at the <br />time and p1 ace specified i n the notice, The hearings off i ci a1 shal 1 deter~- <br />mi ne the abatement costs to be assessed and shall communicate the decision <br />i n writing to the objector which writing shall a1 so state that i f the costs <br />of abatement are not paid within ten days from the date of the decision, the <br />costs shall be entered i n the docket of city 1 i ens and upon such entry shat 1 <br />consti tute a l i en upon the property from which the nuisance was removed or <br />abated or upon the abutting property when the nuisance was removed or abated <br />from the public way. <br />~ 3 } 1 f no objection i s filed or i f the costs of the abatement are <br />not paid within ten days from the date of the notice, an assessment of the <br />costs as stated shall be made by the finance officer and sha11 thereupon be <br />entered in the docket of city liens; and, upon such entry being made, shall <br />constitute a lien upon the property from which the nuisance was removed or <br />Ordinance - 8 <br />
