9,550 Cluster Subdivisions in RA and R-1 Districts, <br />~ e} Compliance with provisions pertaining to Sal ar Design <br />Standards i n connection with planned unit developments occurs, <br />Section 19. The first paragraph and subsection (b) of Section 9.554 <br />of the Eugene Cade, 1971, is amended to read and provide: <br />9.554 Residential District Regulations as to Schools, Churches, Publ i c <br />and Semi -Public Bui l di n s, I n addition to the Solar Setback Stand- <br />ards as provided for in section 9.535, all buildings erected, used, or main- <br />tained for a school, church, or public or semi-public building or use, insti- <br />tution, or similar use under the regulations of this ordinance shall be <br />subject to the fol 1 owl ng requirements : <br />~ b} Interior yards. Buildings and additions shat ] have re- <br />qui red i nter7 or yard setbacks as follows <br />Building or Addition Height Interior Yards <br />5 feet---rrwrr-..-~~wrr~r-sr-.r~wwrr..wwwwwrr~wwwwww 10 feet <br />Over 15 feet----wwwwwww-""'w""""----w--~~ww--w 15 feet <br />l~hen a required interior yard is used far parking or storage and is <br />next to a resi denti al district 1 of ar parcel occupied by a dwel l i ng, <br />it must be screened with year-round, minimum six foot wide, site <br />obscuring vegetation ar separated from the residential property by <br />a si to obscuring, six foot high fence or wall , except as otherwise <br />required i n section 9.544 for fences and wal 1 s i n connection with <br />traffic vision clearance. <br />Section 20. Anew Section 9.576 is added to the Eugene Code, 1911, to <br />read and provide: <br />9,516 Genera] Provisions -Solar Access Guarantee. <br />Purpose, The Solar Access Guarantee protects a solar energy <br />system or the portion of the buildable area located on a 1 of defined by the <br />applicant ~ protected area } from the shade cast by new vegetation planted on <br />other lots, no matter what the zoning district, after the date of an accepted <br />appl i cati an for the guarantee. The Solar Access Guarantee defines height <br />limitations for such new vegetation. <br />~Z} Scope of Protection. The protection from shade afforded by a <br />Solar Access Guarantee may not exceed that afforded by the applicable Solar <br />Setback Standards specified i n section 9.535. <br />~ 3 } Application Standards.
