Ord~~nanee~ ~ 31 <br />~1} A person who: <br />~a} ~liolates, or procures, aids or abets in the violation of <br />any final order or determination concerning the application of a <br />provision of any code adopted in this chapter; or <br />fib} Engages in or procures, aids or abets any other person <br />to engage in any conduct o.r activity for which a permit, certifi- <br />cate, label~or other formal authorization is required by any code <br />adopted in this chapter, or any other regulation issued thereunder <br />without first having obtained the required permit, certificate or <br />label ar other formal authorization therefor, <br />shall be subject to a civil penalty upon conviction thereof of not less than <br />$50, nor more than $200 fora first offense. Fora second offense committed <br />within 12 months from the~date that the first offense was committed, a pen- <br />alty of not less than $Z04, nor more than $400. Fora third offense commit- <br />ted within a 12~month period from the date the first offense was committed, <br />the penalty shall be $500. In the case of a continuing violation, every <br />day's continuance of the violation is a separate violation. <br />(2} The civil penalties impaled by this section are in addition <br />to any other penalty or fee assessed by this chapter and to any other <br />enforcement action authorized. <br />Section 13. References contained in this Ordinance to provisions of the <br />Eugene Code, 1971 which have heretofore been amended, added, or renumbered <br />but are not yet effective are intended to be references to those sections as <br />constituted an their effective date. <br />Section 14. The City Recorder, at the request of or with the concur- <br />rence of the City Attorney, is authorized to administratively change refer- <br />ences in other sections of the Eugene Code, 1971 to sections amended, added <br />or repealed herein as may be necessary to correctly reflect the intent here- <br />of, <br />Section 15. That the matters contained herein concern the public health, <br />welfare and safety and therefore, an emergency is hereby declared to exist, <br />and this Ordinance shall become effective immediately upon its passage by <br />the City Council and approval by the Mayor. <br />Passed by the City Council this <br />Approved by the Mayor this <br />13th day of October, 1956 13th day of October, 1986 <br />
