The owner has days from the date of this post- <br />ing to appeal the determinatian of dangerous building. In addition to posting the dangerous building, the <br />building official shall send a copy of the posting to all per- <br />sons ~n charge~of the property and notify them of the emergency <br />and the conditions which necessitated the determinatian and <br />posting. The notice shall be personally served or sent by <br />certified mail no later than two working days following the <br />date of posting. <br />4. No person shall remain in or enter any building which <br />has been posted as dangerous, except that entry may be made to <br />repair, demolish, or remove such building under permit. No <br />person shall remove or deface any such notice after it is <br />posted until the required repairs, demolition, or removal have <br />been completed and a certificate of,occupancy issued by the <br />building official. <br />5, If any person in charge of the posted property <br />appeals in writing the building official's determination that <br />a building is dangerous a hearing official designated by the <br />city manager shall within a reasonable time fix a time and <br />place fora hearing. Notice shall be mailed to the owner of <br />record of the premises whereon the building is located and the <br />appellant, notifying them that a hearing will be held concern- <br />ing the building official's determination of dangerous build- <br />ing and the time and place thereof. At such time and place a <br />hearing shall be held and the hearing official shall deter- <br />mine whether ar not the building is dangerous. The hearing <br />official`s decision shall be in writing and shall be final. <br />The hearing official may, as a part of the hearing, inspect <br />the building and the facts observed by the hearing official <br />at such inspection may be considered in determining whether <br />or not the building is dangerous. At the hearing, the owner <br />and appellant shall have the right ~to be heard and to present <br />evidence if such owner or appellant requests the same. No <br />irregularity ar failure to mail notice shall invalidate the <br />proceedings. At the hearing, the hearing official shall have <br />
