<br />This bill creates position of Director of Legislative Audit office and authorizes the Director
<br />to conduct performance and management audits of state agencies, state programs and
<br />state-funded programs. In conducting an audit, the Director has the authority to examine
<br />and inspect all accounts, records, files, and documents of any public body, including the
<br />City. This might be a home rule issue except that the Director is only authorized to audit
<br />the City's use of state funds. On the plus side, this may also prevent some government
<br />waste. The bill also transfers the authority to investigate reports of waste, inefficiency or
<br />abuse from the Secretary of State to the Director.

<br />Title: Provides that lawyer-client privilege extends to communications made by or to agent of
<br />client under specified circumstances.

<br />This bill would extend the attorney/client privilege to cover communications between an
<br />attorney and an agent of the attorney's client. This expansion of attorney/client privilege
<br />would protect communications between the city attorney and persons, such as volunteers
<br />or consultants, who may represent the City, but are not city employees or city officials.

<br />Comments:
<br />We support this bill, which would enhance the degree of crime for sexual abuse when it is
<br />committed by an athletic coach or trainer, and would create a penalty enhancement if the
<br />victim is under 18 years of age. Because of the power and influence that coaches and
<br />trainers exert over their athletes, we believe that taking advantage of this position to
<br />commit sexual abuse merits a higher degree of culpability, particularly in cases where the
<br />victim is young.
