Cushman EPD-ADM 2/9/2009 Pri 3 No No Oppose <br />Comments: <br />Although this bill in its current form will not have a direct impact on the City, we oppose <br />the bill because it is bad public policy. We recommend that the City have a formal <br />position of opposition to the bill so that we can respond if asked our position on the bill, <br />but that we not expend any lobbying resources to actively oppose it. <br />This bill creates an unfunded mandate for the Oregon Department of Transportation. It <br />puts a burden on them to remove any debris from a traffic crash involving the death of a <br />person 18 years of age or younger, irrespective of fault. In some cases, particularly in a <br />fatal crash, such clean-up could result in significant expense. And there is no good policy <br />reason to separate out crashes involving those who are 18 years of age and younger <br />from any other fatal crash. This bill appears to be one introduced at the request of the <br />family of such a crash victim. Such particularlized legislation has no place in Oregon law, <br />particularly in the light of increasingly scarce public resouces. <br />If the bill moves, it needs to be monitored for any changes which would impact City <br />ContactRespondentDept Updated Priority Policy Poli Numb Recommendation <br />Tom Larsen Tom Larsen PWM 2/9/2009 Pri 3 No No Oppose <br />Comments: <br />While this bill has no impact on the city as it applies only to teh State Highway <br />deapartment for crashes on State Highways in specific circumstances, it represents very <br />poor public policy. It shifts the responsibility for the cost of vehicle removal and clean up <br />in crashs when a person 18 or under dies from the vehicle owners to the State.
