ORDINANCE No. igys~ <br />AN ORDINANCE AUTHORIZING THE INSTITUTIQN QF <br />PRQCEEDINGS IN EMINENT DOMAIN FQR THE ACQUISI- <br />TIQN BY CONDEMNATION QF PRQPERTY INTERESTS <br />ALONG GILHAM RQAD BETWEEN CRESCENT DRIVE AND <br />HONEYWO4D AVENUE FQR THE PURPOSES OF CoNSTRUC- <br />TIQN QF STREET IMPRQVEMENTS; AND DECLARING AN <br />EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />The City Council has authority under provisions of the City <br />Charter and applicable state law to institute proceedings in <br />eminent domai n for the acquisition by condemnation of private <br />property far public purposes, including the improvement of city <br />streets and c onstruction of curbs, gutters, sidewalks and a ther <br />features. <br />The C ity of Eugene is in the process of improving C ity <br />streets and on November 17, 198G the Council enacted Resolution <br />No. 413 initiating the Gilham Road Improvement Project from <br />Crescent Avenue to Honeywood Avenue, which includes street <br />improvements consisting of paving, curbs, gutters, sidewalks and <br />street lights, and sanitary and storm sewer improvement. <br />The proposed improvements are in compliance with and in <br />furtherance of the plans and specifications prepared by the City <br />Engineer in accordance with provisions of Chapter 7 of the Eugene <br />Code, 171 and applicable policies of the City of Eugene. <br />The costs of delaying the project, the savings from effi- <br />cient construction management techniques, and the need to facili- <br />tate the safe and efficient movement of traffic r. equines the City <br />to act promptly to acquire the necessary property interests f or <br />ordinance - 1 <br />
