ORDINANCE N0. 19~t 6S <br />AN ORDINANCE AUTHORIZING AND CREATING PROCEDURES FOR THE <br />DISPOSITION OF SURPLUS REAL PROPERTY BY THE EUGENE WATER <br />& ELECTRIC BOARD; ADDING A NEW SECTION 2.196 To THE <br />EUGENE CODE, 1971; AND DECLARING AN EMEREGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Anew Section 2.196 is hereby added tv the Eugene Code, 1971, <br />to read and provide; <br />" 2.196 Eu ene Water & Electric Board - Dis osition of Real Pro ert . The <br />board may dispose of real property not needed for utility ur oses <br />in accordance with state 1 p p <br />aw. In the event the board or its designee deter- <br />mines that real property is not needed for utility purposes, it shall afford <br />the city the opportunity to obtain the property for other munici al ur oses <br />p p p <br />by not~fy~ng the city manager of its availability. If the cit desires to <br />obtain the ro ert th ~ ~ y <br />p p y, , e c~ ty manager shal l request negot~ at ~ on w~ the n th ~ rty <br />~3G} days of the not~f~cat~on. As soon as possible after notification the <br />city manager and the board's general manager shall ne otiate an a reement to <br />g g <br />compensate the board for the property transferred ~n accordance with a reed <br />cri teri a~. An a reed transfer ~ 9 <br />y g to the c7ty and compensation to the board <br />shall be completed within five t5~ years from the date of notification. The <br />board may dispose of the property by such means and terms as it deems a ro- <br />pr~ate ~f the cit mana er fails to pp <br />y g request negotiations within thirty X30} <br />days of notification of availability or if the property transfer is not com- <br />pleted within five ~5} years of that notification. <br />Section 2.
