GRDINANCE N4 . <br />An Ordinance vacating the following described street, to- <br />wit ; <br />That portion of the right-of-way of 12th Avenue <br />extending from the west margin of the right-~of-way of <br />Hilyard Street to the East margin of the right-of-way <br />of Patterson Street, between Blocks 2 and 5, Shaw's <br />Second Addition or Shaw and Patterson's Addition to <br />Eugene City know called Eugene, as platted and <br />recorded in Volume G, Page 364, Lane County, Oregon <br />Deed Records, in Lane County, Oregon. Sacred Heart, <br />SV 87--4 ~ <br />RESERVING herein an easement 44 feet in width along the <br />northern margin of the above described property for its <br />entire length for use for emergency vehicles, far <br />pedestrian and bicycle access by the general public, <br />and far public utility purposes under the above <br />described property and the right to enter thereon for <br />purposes of construction, reconstruction and <br />maintenance. The easement reserved herein shall not <br />prevent building construction overhead above a <br />clearance of 15 feet. <br />On the 27th day of January, 1985, the City Council of the <br />City of Eugene passed Qrdinance No. 19535 settin a hearin to be <br />g g <br />held at 7:30 p.m., Pacific Time on the 14th day of March, 1988 <br />at the Council Chambers at City Hall, Eugene, Oregon, at which <br />time and place protests and remonstrances could be heard as to <br />the proposed vacation of the above described street. <br />Notice was duly and regularly given of the hearing and at <br />said time and place the hearing was postponed by the Council and <br />rescheduled far its meeting of April 11, 1958 pending a final <br />determination by the Planning Commission of an appeal from the <br />Hearings Official's decision granting a conditional use ermit <br />~: p <br />involving the above described property. <br />The Planning Commission has upheld the Hearings Official's <br />decision, and the Council has heard all objections to the <br />Ordinance - 1 <br />
