ORDINANCE NO. ~CQ~ <br />AN ORDINANCE AUTHORIZING THE INSTITUTIQN OF <br />PROCEEDINGS IN EMINENT DOMAIN FOR THE <br />ACQUISITION BY CONDEMNATION OF PROPERTY <br />INTERESTS IN THE vICINITY OF THE RIDGELINE <br />PARK FOR THE PURPQSE OF THE EXPANSION OF THE <br />RIDGELINE PARK ~,ND TRAIL SYSTEM, AND OTHER <br />PUBLIC PURPOSES; AND DECLARING AN EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />The City Council has authority under provisions of the Cit <br />Charter and a livable state ~ 'y <br />s pp law to institute proceedings in <br />eminent domain for the acquisition by condemnation of rivate <br />propert for ubliv ur os ~ P <br />Y p p p es, including the expansion of Clty <br />parks, trails, and other public purposes. <br />The City of Eugene is in the process of ex andin the <br />Ridgeline Park and Tr p g <br />,ail system, which necessitates the <br />acquisition of property interests in that vicinity. <br />The proposed expansion of the Ridgeline Park and Trail <br />system is consistent with the adopted goals and ob'ectives of the <br />Cit 's South Hills S ~ <br />Y tudy, and other applicable pola.cies of the <br />City of Eugene, <br />Now, therefore, <br />THE CITY CF EUGENE DQES ORDAIN AS FOLLOWS: <br />Section ,,1, Based upon the above findin s which are <br />incorporated herein b re g <br />y ference and hereby adapted, the City <br />Council of the City of Eugene does hereby find, declare and <br />determine it necessary to acquire certain ownershi in fee <br />interest or recreatio p <br />n easements consisting of up to <br />approximately 15.0 acres in the northeast corner of the arcel of <br />real pro ert more articula ~ ~ p <br />p Y p rly described an Exhibit A attached <br />hereto and incorporated herein by reference in order to ex and <br />the Ridgeline Park and Trail s s p <br />y tem. <br />Section 2. The City Council does hereby direct that the <br />City of Eugene shall institute proceedings in eminent domain for <br />the condemnation of the real property interests described in <br />Section 1, and, at least 20 days prior to the filin of an <br />action for condemnation to g Y <br />make a written offer to the owners or <br />parties having an interest therein of a stated amount as <br />compensation therefor and for any compensable dams es to <br />remainin ro ert g <br />gp p Y <br />Section 3.
