X34} Section 17.203 of the Uniform Fire Code is deleted. <br />X35} Section 18.102 of the Uniform Fire Cade is amended to read: <br />Sectian 78.102 - Permits for Manufacturin Sale and Dischar e. <br />'~a} The manufacture of fireworks within the jurisdiction is <br />prohibited, <br />fib} Nv person shal 1 sell , keep or offer far sale, expose for <br />sale,,possess, use, explode or have exploded any fireworks within <br />the city, except as permitted by section 78.105 and as follows: <br />1. Sales to, use, possession or explosion by persons <br />having obtained a permit from the State Fire Marshal for <br />supervised public display. <br />2, Sales to, use, possession or explosion by railroads, <br />boat, motor vehicle ar other transportation agencies, for <br />signal, warning, or illumination purposes in connection with <br />such businesses. <br />3. Sales to, use, possession or explosion of blank car- <br />tridges for licensed shows or theatres or for signal or cere- <br />monial purposes in athletic or sporting events. <br />4. Sales of blank cartridges far use, possession or ex- <br />plosion by the armed forces or any organization of war veter- <br />ans or other organization authorized by law to parade in <br />public a color guard armed with firearms. <br />~c} Sales permits for fireworks ar items shall not be valid <br />for more than one year from the date of issue. a public display <br />permit shall not be valid far mare than ten days from date of issu- <br />ance and shall only authorize one fireworks display during that <br />period. <br />~d} Applications for permits shall be made in writing to the <br />State Fire Marshal at least 15 days in advance of the date of the <br />sale or display. <br />X36} Sectian 15,103 of the Uniform Fire Cade is amended to read: <br />Section 18.103 - Fireworks - Liabilit Insurance. Persons apply- <br />ing for permits pursuant to section 18.102~b}1, shall supply the Fire Pre- <br />vention Bureau with proof of liability insurance or other form of indemnity <br />in an amount not less than $500,000 conditioned for payment of all damages <br />which may be caused either to a person or property by reason of the author- <br />i zed d~ spl ay Or sale and arising from any acts of the applicant, his ar her <br />agents, employees or subcontractors. <br />X37} Section 18.105 of the Uniform Fire Code is deleted. <br />X38} Section 18,106 of the Uniform Fire Code is amended to read; <br />Sectian 18.106 - Fireworks, Seizure. The fire marshal shall seize <br />and remove, or cause to be seized and removed, at the expense of the owner, <br />all stocks of fireworks sold, offered ar exposed for sale, stored, possessed, <br />or held i n violation of this article. <br />X39} Section 18.107 of the Uniform Fire Code is added to read: <br />Section 78.101 - Fireworks, Salable Items. Sale, use and posses- <br />sion of the following items is permissible at all times; <br />~a} Items excluded in Sectian 9.108. <br />fib} Sparklers. <br />{c} Snakes and similar smoke-producing material that produces <br />no v~s~ble flame during discharge, na after-smoldering, and insuf- <br />ficient heat to ignite readily combustible materials upon which <br />the devices or materials are placed. <br />Ordinance - 16 <br />
