AttachmentA-ExhibitD <br />LegislativeFindings <br />toOrdinanceNo.__________ <br />(LegislativelyUpdated) <br />CodeAmendments. <br />EugeneCodeSection9.8065requiresthatthefollowingcriteria(inbold <br />anditalic)beappliedtoacodeamendment. <br />(1)IsconsistentwithapplicablestatewideplanninggoalsasadoptedbytheLand <br />ConservationandDevelopmentCommission. <br />Goal1CitizenInvolvement:Todevelopacitizeninvolvementprogramthatinsuresthe <br />opportunityforcitizenstobeinvolvedinallphasesoftheplanningprocess. <br />TheCityofEugenelandusecodeimplementsStatewidePlanningGoal1byrequiringthat <br />noticeoftheproposedamendmentsbegivenandpublichearingsbeheldpriortoadoption. <br />TheprocessleadinguptothedevelopmentoftheWaterQualityWaterwaysOrdinancehas <br />providednumerousopportunitiesforcitizeninvolvement.InJune2006,thecityhostedanOpen <br />Housetoprovideinformationandreceiveinputonapreliminaryproposalforwaterquality <br />waterwayprotection.Noticeoftheopenhousewassenttoallpotentiallyaffectedproperty <br />owners,andalistofover300interestedpersons.Anewsreleaseabouttheopenhousewas <br />issuedandadisplayadwasplacedinthelocalnewspaper.Awebsitewasestablishedtoconvey <br />informationabouttheproposal,thecitizeninvolvementandadoptionprocess,andstaffcontact <br />information.ThreenewspaperarticleswerepublishedinthelocalpaperbetweenJune2006and <br />August2006regardingtheproposal.Subsequenttotheopenhouse,betweenAugust2006and <br />March2007,fourseparatepostcardsweresenttoallpotentiallyaffectedpropertyownersand <br />interestedpersonstoconveythemostup-to-dateprocessandtimeline,aprojectwebaddressfor <br />additionalinformation,andstaffcontactinformation.Sitevisitswereconducteduponrequestto <br />confirmtheaccuracyoftheCitysdigitalinformationregardingtheexistenceandlocationof <br />waterways,andtheapplicabilityoftheproposedprotectionstoindividualsites.Presentations <br />abouttheproposalweremadetointerestedgroupsuponrequest.Thecitizeninputreceivedon <br />thepreliminaryproposalresultedinsignificantchangesandinNovember2007,anotice <br />describingtherevisedproposalwassenttoallpotentiallyaffectedpropertyownersand <br />interestedpersonswithanupdatedpublichearingandadoptionschedule. <br />TheCityofEugeneslandusecodeimplementsStatewidePlanningGoal1byrequiringthat <br />noticeoftheproposedlandusecodeamendmentsbegivenandpublichearingsbeheldpriorto <br />adoption.ConsiderationofthisordinancebeganwithaEugenePlanningCommissionwork <br />sessiononJanuary14,2008.OnJanuary15,2008,apublichearingwasheldbeforetheEugene <br />PlanningCommissionontheproposedamendments.DepartmentofLandConservationand <br />Developmentnotice,noticetoaffectedpropertyowners,PlanningCommissioners,neighborhood <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page1of17 <br />
