ORDINANCE NO. ~~~ <br />AN ORDINANCE CONCERNING BONDING REQUIREMENTS <br />FCR ALARM EQUIPMENT SUPPLIERS AND ALARM <br />MONITOR2NG SERvICE5; AMENDING SECTION 3.010 <br />OF THE EUGENE CODE, 1972; AND DECLARING AN <br />EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />The table of licensed businesses contained in Section 3.010 of <br />the Eugene Code, 1971, provides that applicants for an Alarm Equip- <br />ment Supplier and Alarm Monitoring Service license must provide a <br />surety bond in the amount of $10, 400.00, M <br />The expense of providing a bond in this amount creates a finan- <br />cial hardship for licensees, and the Finance Director has recommended <br />that the bonding requirement be lowered to $5,000.00. In making <br />this recommendation the Finance Director advises that during the <br />approximately eight years this requirement has been in effect, no <br />claims against a bonded licensee have been filed with the City, and, <br />further, it is extremely unlikely that if any claims were made that <br />they would exceed $5,000.00. In addition, other cities such as <br />Portland and Salem have found their bonding requirement of $5,000..00 <br />to .be more than adequate. <br />The City's Police Department and Fire Department have been can-- <br />sulted by the Finance Director and concur with his recommendation <br />that the banding requirement be lowered to $5,000.00, <br />Based upon the above findings, it appears to be in the best <br />public interest to lessen the financial burden on these licensees <br />by decreasing the bonding requirement to $5,000.00. <br />Now, therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The band requirement for Alarm Equipment Supplier <br />and Alarm Monitoring Service as set forth in Column E of the table <br />of licensed businesses in Section 3.010 of the Eugene Code, 1971, <br />is hereby amended by deleting the figure $10,000 and inserting <br />therein the figure $5,000. <br />Section 2. That the matters contained herein concern the <br />public welfare and safety, and in order tv assure the orderly imple- <br />mentation of these provisions, an emergency is hereby declared to <br />exist, and this Ordinance shall become effective immediately upon <br />its passage by the City Council and approval by the Mayor, and shall <br />apply far all licenses issued or renewed after January 1, 1983. <br />Passed by the City Council this <br />day of ~~ ~~arch ,: ~ 19 8 3 <br />City Re order <br />Approved by the Mayor this <br />day of ~~~arch ~ l9 8 3 <br />3 <br />~- <br />~~~ayor <br />Ordinance. <br />
