ORDINANCE NO. ~~ <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF <br />PROCEEDINGS IN EMINENT DOMAIN FOR THE ACQUISI- <br />TION BY CONDEMNATION OF PRQPERTY INTERESTS FOR <br />THE CONSTRUCTION OF A SUMP STATION AT BARGER <br />DRIVE AND TERRY STREET AND A SANITARY SEWER CON- <br />NECTING THE PUMP STATION WITH THE REGIONAL <br />TREATMENT PLAN' ; AND DECLARING AN EMERGE~~CY . <br />The City Council of the City of Eugene finds that: <br />The City Council has authority under provisions of the City <br />Charter and applicable state law to institute proceedings in eminent <br />domain for the acquisition by condemnation of private property for <br />public purposes, including the construction, maintenance, operation, <br />expansion and improvement of the sanitary sewerage system. <br />The City of Eugene entered into an intergovernmental agreement <br />on February 9, 1977, with the City of Springfield .and Lane County to <br />establish a Metropolitan Wastewater Management Commission for the <br />purpose of constructing, operating and maintaining regional sewerage <br />facilities in order to provide safe and efficient treatment of sewage. <br />The construction of a pump station in the vicinity of Barger <br />Drive and Terry Street and the West Eugene Pressure Line from the <br />pump station to the regional treatment plant necessitates the acqui- <br />sition by the City of certain property rights in the parcels of real <br />property described on the attached exhibits, which in the City's <br />judgment constitutes the mast beneficial and practical location for <br />the construction. <br />The proposed improvements are in compliance with and in further- <br />once of the plans and specifications prepared by the City Engineer <br />at the Councils direction and in accordance with provisions of the <br />ordinance - l <br />
